We have a very long discussion on this list on this issue. Although there is certainly some considerable sympathy for the predicament the lady finds herself in, such sympathy is actually ill informed or motivated.
Sadhvi Pragya is a disciplined soldeir of her party which is arranging everything for her legal defence, including up to the Supreme Court, so as to keep her plight alive in the public eye. Detailed and very reasoned orders have been passed in her case to deny her bail.
OTH, this incident of Italian marines is truly shocking and shows how the Highest Court in the nation is a party to this fraud. Lets understand the sequence of what happened
Last year 2 Italian marines killed 2 Indian fisherman from Kerala "mistaking" them for "pirates". The marines obtained bail from the Kerala HC on very relaxed terms, this was challenged and they asked to go home for Christmas and return like good little boys. The Kerala Govt it seems had cut a deal with the Italians to allow them to leave after giving Indian sureties of Rs. 1 crore each. The Central Govt objected the sureties given by the Italian embassy are worthless since they would claim diplomatic immunity.

Here is where the story gets murky.
After lulling the Govt into believing they would submit to India's jurisdiction the marines approached the Supreme Court to dilute this clause of Indian sureties saying that they next needed to go back to Italy to cast their votes in person. The Assistant Solicitor General P.P. Malhotra disbelieved them and sought time to confirm if they had to go back or of they could cast votes through the post. At this stage somebody handed over an undertaking (sovereign guarantee) from the Italian Government to the Court that they would return whenever called for.
The Apex Court, surprisingly, took cognisance of this worthless diplomatic undertaking and while handing over the marines to the care and supervision of the Italian Govt. noted In its order that the Italian government would be free to raise the question that Italy had the jurisdiction to conduct the trial of these two Italian marines in their country.
The Italian Govt is now saying that they have the clearance of the SC to dispute India's jurisdiction.over the trial.
How did this happen ? There is a scandal. This shows the direct involvement of the Court in this fraud on the people if what is reported in the media is correct. Even the Rs.1 crore sureties, if actually given, are a pittance nowadays.
As it is also too many complaints are coming in from the Bar about the functioning of this Chief Justice of India's bench including from the President of the SCBA Mr. Krishnamani.
