Dear Friends,

We urgently need reforms in every sphere of the Government. We do not see much improvement in the governance of our P.M. Judicial reforms are very urgently needed but who can do this? I have read that the Chief Justice of the Supreme court started crying and tears rolled down in a public meeting.

I do not think that this would cut any ice with the Government> The CJI should give a notice to the Government and ask for immediate reforms. In case the government is not taking any action the Judiciary should en mass resign. No use crying.

Some of the urgent needs of the judiciary where government needs to act are

1. Fill all the vacancies of judges in the next few months after following the due selection process.   I do not think we have ant dearth of advocates who will fill in these posts.

2. Organise two shifts till such time the infrastructure required for our courts are met with. All industries work and why not the judiciary?. The timings could be fro 8 A.M, to 2 P.M. with a suitable break for one hour in one go or in two. The second shift should start from 2 P.M. to 8 P.M. with a suitable break

3. Pass a law to cancel the remands of accused staying in custody and release them if their stay in the custody exceeds 50% of the maximum punishment  that would have been given in case of conviction.

What judiciary can do are

1. Do not allow any adjournment except one for each of the parties and thereafter impose a penalty of Rs. 5000 to 50,000/- depending on the cases and gradually increase the fine which should be shared equally by the government and the other party.

2. All cases pending for more than 7 years to be cancelled and ask the litigants to apply afresh without any further costs as if they are new cases with all the evidences for a speedy disposal of the cases.

3. The judges should not take leave without planning for the same and accordingly give dates for the hearing. Exceptions may be allowed but that should be very few and far between.

4. appoint a committee of judges/ advocates to recommend further measures  for faster disposal of cases.

5. Appoint senior and deserving advocates as judges to dispose of cases in one sitting  of Cases involving minor amounts say below Rs.1,00,000/-

in private courts as is done in USA.

6. Declare in public may be in each of the courts  the fees to be paid by the litigants to their own advocates. As of now the public is not aware of the same and the advocates charge as they please and some times the litigants pay very little or no fees to the advocates.

7. The CJI should set targets for the judges and judge their performance accordingly for future promotions.

8. Appoint a committee of advocates to analyse the delays and gather statistics about how many case were heard and how many were given dates just like that without any valid reasons.

9. Increase the court fees and it should not be less than Rs.25,000/- per case exceptions could be given by the judges on merit and reduce the fees.

Will the Government and the CJI take note of these reforms and implement the same urgently. Who will take up these reforms to the concerned persons?

Thanks,

Col.V.Nanda Gopal.(retd) ( Had presided over a court martial involving a murder case and corruption cases against JCO s and NCOs. dis posed them speedily within weeks and no adverse comments on the decisions by Advocate General s office. Also presided over a number of courts of enquiry.)

It is not merely working hours and holidays. Even the fairness of judgments and their enforcement are  very important. Firstly the judiciary does not even punish corrupt and delinquent public servants. It is rarely that they make even some meaningless comments on the criminals if they are public servants. This is one of the major reasons why these public servants are repeatedly committing crimes and even making them more and more serious! When it comes to orders in favour of litigants from the public again they fail to enforce their orders making the citizens run from pillar to post in vain and finally resort to litigation in the nature of contempt of court! Anyhow, suffice to say, everything is rotten in our judiciary and reforming it would involve herculean effort!

The mountain of pile up of cases is indeed a matter of immense concern. Over three crore cases in trial Courts, a whopping 41 lakh in the 24 High Courts and a mind boggling over 60,000 in the Supreme Court is no easy task to grapple with.

The concept of evening and night Courts is impractical and having been tried in some states has miserably failed. Infact reducing the number of court holidays may be the way to go. Optimizing the working of the Courts during the day must be the thrust by possibly even increasing the Court working hours by an hour or two.  But for all this to happen only persons with sound knowledge of law and impeccable integrity must be selected as Judges at all levels of the Judiciary.

RE: [IAC#RG] DELHI CHIEF MINISTER ARVIND KEJRIWAL EXPOSED

Dear Fellow Bharatiya,

I have been reading and following discontents of people associated with IAC for some time. Once in a while it appears as if IAC is truly in opposition of Delhi politics but not being consistent. Kejriwal is the product of Indira Gandhi's politics and Shriman Modi failed to oppose him in timely manner. Kejriwal needs to be crushed like walnuts shell to bring the walnut fruit outside. Why is it difficult for central government, that should be the core of discussion? One must ask why Modi is so weak in his own home than showing strength out side home, especially western nation? Whenever PM ignores his own country, filthy goat politicians like Kejriwal wear skin of tiger and roar. Unfortunately, such fake tiger make common inhabitants suffer in unnecessary fear.

Change should have been good . What may be compulsions that Kejriwal could take action for all the wrongs of Asiad so well reported by the media at that time . One reason may be that he has no powers to operate as a full fledged CM of the State .  Another reason could be  the disgruntled bureaucracy who continue to be  in  power ,  have kept the  secrets of misdeeds of earlier governments  .He might have failed in taming the bureaucrats

Governance is a matter of perception within practical limits. Thus, let us not getting carried away on this issue. Here too, Kejriwal is not performing up to par.

Kejriwall never wanted to be a politician. Politician Kejriwal was born out when chided and instigated  by the so called "experienced politicians" when he sat with Anna Hazare fighting corruption.
The learned politicians mocked him telling that if you want to  curtail corruption get elected and fight. Kejriwal can never become a politician of the type we have experienced and are experiencing.  The very
 high-handed attempt by Delhi Chief
Minister Arvind Kejriwal to try and regularize the
 appointment of his 21
illegal Parliamentary Secretaries has only exposed the
 political bankruptcy of
the Aam Aadmi Party. The President of India Pranab Mukherjee
 has rightly swept
 away and   binned Arvind
 Kejriwal's unlawful proposal.

 A rvind Kejriwal
needs to be condemned for having
ventured in appointing parliamentary secretaries despite the
 Courts having
clearly ruled that it was unconstitutional and an unlawful
 mode to give MLAs
cabinet status through the back door. It has only uncovered
 Arvind Kejriwal's
deceitful portraying that his party does not have lust for
 power. While
claiming to be clean and honest, this proposal was most
 dishonest, attempting
to smuggle in persons with positions and perks, but by the
 back door!

 Appointment of
 parliamentary secretaries and
conferring them with rank and status of a Cabinet Minister
 is a fraud on the
Constitution of India. It is in rank violation of the 91st

That is why I have maintained all the time that Politicians are one creed-whatever may be the party. Free movement of politicians from one party to another is solid proof of that. We just keep on wasting our time and energy either in abusing one party or the other or becoming ga-ga over one party or the other. At least intellectuals should realise this and not have conflict with each other for supporting one political party or the other.

Dear Mr. Rodrigues

Are you talking about that party which openly accepts they are
two-faced forked tongued double dealing 'jumla' scam artists who never
wanted India to be independent from foreign rule?

or,

about the mafia party which originally licenced the casinos but is now
feigning that they don't know who let the dogs in and who all actually
connived in passing The Goa Public Gambling Act 1976 amendments in the
1990s ? (NB: I recall it was Congress's CMs - RS Naik and PS Rane who
passed those 2 brazen amendments in 1992 onwards).

Is it also high time there is a national moral movement for
governments which ban / prohibt / criminalise all major forms of vice
eg. drugs, gambling, liquor, brothels, tobacco, gutka etc and forgo
the revenues from these which allow these bloated governments to carry
on after making their populations into addicts ?

Some morally inclined people, who met me a few days back, go a step
further to ask that declared registered addicts to these vices should
be given very limited / rationed supplies by the State with the
proviso that they will not be allowed to vote until 2 years after they
get de-addicted.

about the mafia party which originally licenced the casinos but is now
feigning that they don't know who let the dogs in and who all actually
connived in passing The Goa Public Gambling Act 1976 amendments in the

Re: [IAC#RG] DELHI CHIEF MINISTER ARVIND KEJRIWAL EXPOSED

Change should have been good . What may be compulsions that Kejriwal could take action for all the wrongs of Asiad so well reported by the media at that time . One reason may be that he has no powers to operate as a full fledged CM of the State .  Another reason could be  the disgruntled bureaucracy who continue to be  in  power ,  have kept the  secrets of misdeeds of earlier governments  .He might have failed in taming the bureaucrats

Kejriwal has destroyed all the principles for which a new party (AAP) was launched despite India having over 1400 political parties. He is a cheater and stabber (not to me or you on a personal level) to the whole movement in that sense.

As a matter of fact  Kejriwal should join hands with Modi, notwithstanding differences, if they have to fight corruption nationally

I asked under RTI details of his claims regarding making 5 crore dispensary in 15 lacs, giving subsidy in water and electricity by savings made by reducing corruption. I got 27 letters sending my application from one department to another. Only reply i got was Rs15 lacs is cost of only furnishing, no equipment or premises cost. WILL YOU CALL HIM HONEST?

[IAC#RG] DELHI CHIEF MINISTER ARVIND KEJRIWAL EXPOSED

 The very
 high-handed attempt by Delhi Chief
Minister Arvind Kejriwal to try and regularize the
 appointment of his 21
illegal Parliamentary Secretaries has only exposed the
 political bankruptcy of
the Aam Aadmi Party. The President of India Pranab Mukherjee
 has rightly swept
 away and   binned Arvind
 Kejriwal's unlawful proposal.

 A rvind Kejriwal
needs to be condemned for having
ventured in appointing parliamentary secretaries despite the
 Courts having
clearly ruled that it was unconstitutional and an unlawful
 mode to give MLAs
cabinet status through the back door. It has only uncovered
 Arvind Kejriwal's
deceitful portraying that his party does not have lust for
 power. While
claiming to be clean and honest, this proposal was most
 dishonest, attempting
to smuggle in persons with positions and perks, but by the
 back door!

 Appointment of
 parliamentary secretaries and
conferring them with rank and status of a Cabinet Minister
 is a fraud on the
Constitution of India. It is in rank violation of the 91st
 Amendment which was meant
to restrict the size of the Cabinet to prevent jumbo size
 cabinets which are a
huge financial burden to the State Exchequer.
