independence of judiciary means they could give dictatorial orders ignoring the law/statutory regulations. knowing fully that there is nothing beyond them.    in cases against the govt.  some  give orders on the basis of sole advise given in chambers by the SG/ASG without allowing petitioner to argue and then get appointed to panels before actual date of retirement. enjoy the fruits of misuse of power till age 70 atleast.  example -  J bhandari and ex J mukundakam sharma did that and got that. rgds. beniwal

Responding late. System of colleguim was evovled by the supreme court and there are not agreeing to any change which the Govt. has tried under the guise of much needed judicial reforms. So the status quo continues and now it appears that there is a tacit understanding between the executive branch and judiciary that the Govt. will not interfere in judicial processes and the judiciary will not interefere in policy matters.
Regarding employment of judges after retirement, the Govt. has been using is as an inducement. The appointment of ex-CJI Balkrishnan, CJI (ex) Verma and J. Katju need to be looked at from that angle.
J. Katju has become controversial after making politicial statements against Arun Jetley,leader of oppositon inRS>. Even during his tenure he was not in favour of PILs as these amounted to oversteping into executive(read Govt.) functions .
So we come back to the same basic questions of making reforms in judiciary to eliminate corruption-whethre in appointment or its functioning or re-employment after retirement.

I feel that the collegium system needs overhaul, but protection from politicians at the same time, if such a thing is possible.
The CJI, PM, Leaders of opposition in both houses, chairman of bar, chairman of CAG, CVC should be the "collegium." They should appoint with 75% agreement IN WRITING.
There should be open grilling of candidate and process on national tv.

[IAC#RG] महात्मा गाँधी और नेताजी

महात्मा और नेताजी

गाँधी जी के सत्याग्रह में भी , खड़े रहे थे नेताजी ,
साथ छोड़ा था तो वक़्त और वतन की जरूरत के लिए,

माना की भूख हड़ताल से, थर्राया था गोरों का शासन ,
आजाद हिन्द फ़ौज ने भी खून दिया, जम्हूरियत के लिए .

मकसद दोनों के एक ही थे , आजाद हो हमारा वतन,
दोनों तरीके जरूरी ही थे, अंग्रेजों के रुखसत के लिए .

संघर्ष किया था गाँधी ने 'पूर्ण स्वराज ' के नारों से ,
'दिल्ली चलो ' भी याद रहेगा आज़ादी की ज़दोजहत के लिए.

अन्ना ने है आस जगाई , देश में आएगी सुचिता ,
अरविन्द ने भी अलख जगाई, आम आदमी की हुक्कुमत के लिए.

झुकता है सर सम्मान से गाँधी सरीखे अन्ना पर ,
बाहें फैलाये खड़े हैं हम शुभाष सा सख्सियत के लिए.

Cromwell as i understand was a Military man and having the qualities of Platonic hero ideals smashed everything and tried to establish oligarchy a system better than monarchy to establish a better rule in Briton.

I don't see any "squabbles". At IAC we have always placed "Defence of the Indian nation and its brave defenders" as our #1 priority.

I also don't see why we should react to jingoism in a trade journal. IDR is a vested interest. As it is much of the public is concerned with the "big ticket" arms deals done in a corrupt fashion which is taking money out of India away from basic infrastructure on which it could be better spent.

Since from now on, our mailing lists are going to be very sparingly used, we have opened a brand new forum for such discussions

Your suggestion  is good. Both individually and collectively to fight against corruption, we need functional judiciary with time bound justice delivery needed alongwith affordable and easily accessible to common citizen.  In any action of govt. we need time bound service delivery which should be mandated with a very shorter time in the age of information technology. We need to focus on this issue. The role of govt. should be limited to certain area. Once it is implemented, we don't give the so called speed money to get our legitimate right. Now time has come to assert ourselves.

                                                                             TO ANTI CORRUPTION CAMPAIGN
India today faces  challenging problems on multiple fronts.  However,  the basics of the country are still strong , as evident from the national disgust  against the forces of corruption.
The problem is  that  the country's administration is  largely under the control of the corrupt people who can be described as commission agents.  
 Strong   and vocal public opinion  and passive resistance  (such as Gandhiji's non cooperation movement)  can  alone challenge  the corrupt elements, who now constitute the largest segment of the politicians in all political parties.
The patriotic men and women  should make the anti corruption sentiments as the central  theme  in any activity  and in any discussion  in  any forum  and constantly  send  communication  opposing the corrupt  persons in government and in political parties at every  opportunity. They  should  not  become part of the corrupt system  under any circumstances  and refuse to pay bribe  and in the process whatever the sacrifices that are needed should be made willingly.
The biggest corruption is taking place amongst the people  in the middle and upper income group who are supposed to be educated  and well  informed.  The poor people who are forced to pay bribes  are helpless and they are too weak to resist.  But, this is not so in the case of those  belonging to middle and upper income group.  Certainly, they can afford to resist in their own way and when they do not do so , they should be held responsible for  the climate of corruption that is now sweeping the nation.
The people in the middle and upper income group  should come forward and resist at their own level , which need not mean demonstration or violence. Simple refusal to  heed to the demand for bribe by large number of concerned  and educated people will work wonders  in defeating the  corrupt forces.
While other forms of anti corruption movement such as moving the judiciary , using  RTI  etc. should continue , the individual resistance will enhance the quality of the movement to the highest  standards  and  infuse  vigour and  purpose.
Let all of us  decide that  the message of anti corruption should spread everywhere by passive resistance at individual level  and let it culminate in 2014 elections for good. Such strong campaign will  encourage  honest people to contest in the elections  and give an opportunity  to bring the anti corruption issue as the focus of 2014 election.

[HumJanenge] LIC HOUSING FINANCE - ITS STATUS AS PUBLIC AUTHORITY

LIC Housing Finance has replied to an RTI applicant that it is not covered under the RTI Act as it does not use public money. I want to know whether the claim of LIC HF is correct or against this decision, he should go in appeal before the FAA and the CIC.

I am annoyed by the fact and the things going on in this country.Every thing is free for the rulers to loot, miss handle,exploit,and even tamper the fact coming up in the public domain .What will be fate of this country? and the fate of this poor voters who blindly voted for the last 50 years to a family which has ruined this country-men .Alas ! God alone can save us

Thank heaven for little Doordarshans . An offshoot of the government-controlled TV behemoth, Doordarshan Bharati, broadcast a moving hour-long documentary on the late genius Ustad Amir Khan, at least 35 minutes of which was free from the excesses of a garrulous presenter and experts tripping over their own repetitions . This unknown channel had the pawmarks of its parent's ethos: a logo like a design patch from a 19th century sari; a script font quivering in a style that was synonymous with deep emotion in the 1950s. But whenever Doordarshan dips into that treasure house, its archives, there is magic.

This should be Doordarshan's true public calling. It should eliminate news from its oeuvre, since it is run by politicians. News is almost always injurious to any government's health. Propaganda is safer, so Doordarshan is ordered to sell propaganda as news. Why should our taxes pay for political propaganda?

You can measure a government's desperation by the effort it puts into disinformation. Doordarshan reported the AgustaWestland scandal not, as others did, with evidence gathered by the Italian police, but with stress on some heavy breathing by our defence minister, St Antony of Kerala, who suddenly discovered the virtues of transparency and "experts" of the sort who claimed they had never witnessed such ministerial integrity ever before. There was, naturally, no mention of AK Antony's shocking silence over the past 11 months when he repeatedly shrugged off details of the scandal brought to his notice.

Fortunately, the Italian government did what the Indian government refused to do: investigate on its turf. Antony remained curiously unmoved even when the name of a service chief popped up, with implications on the credibility and morale of the force. A Member of Parliament, Prakash Javadekar, wrote to him. Antony continued to do nothing. Why? Antony calls himself an honest politician. If, therefore, Antony was not protecting himself, who was he protecting?

The defence ministry's explanation for inaction was silly. It sent a request for information to Rome through the external affairs ministry. When it got nothing, it did nothing. But this was always an Indian crime as much as an Italian one. Italy did not wait for information from India; why did India wait for Italy?

In any cover up, deft use is made of that extremely useful fish called the red herring. A shoal of facts, mostly irrelevant, is thrown into the stream of information to divert the chase. Let's keep this simple.

What are we looking for? Evidence of bribes through agents. The concern is not about the quality or specifications of the helicopter, which may all be very good indeed, but the fact that commissions were given to honour what former Italian Premier Silvio Berlusconi has called the rules of the system. According to the confession by Guido Haschke, the principal middleman, to the Italian police, bribes began to flow from 2007 and continued till 2011. We know who was in power in Delhi then. Haschke got 20 million euros, and allegedly passed on 12 million to Sanjeev and Rajiv Tyagi, relatives of ex-IAF chief SP Tyagi. Why did the Indian government look the other way?

There is at least one good political reason for Antony's prevarication. It is reasonable to assume that he hoped that delay would push the investigation process beyond the general election in 2014. This government's bliss is directly proportionate to voters' ignorance. Antony's shock at Italy's speed was evident on his face.

The manipulation of time is part of political strategy. CBI moves rapidly against an electoral adversary of the Congress like Jagan Reddy. CBI becomes immobile when told to move in the coal block fraud, since friends and cronies of ministers are involved. Five months ago, after massive public outcry, CBI was given charge of "coalgate" . We have just learnt from CBI's director Ranjit Sinha, who appeared before a parliament committee, that his agency has not yet received files he asked for. The distance between the two offices can be covered by a pleasant walk, but neither demand nor delivery was considered worth any hurry.

Jagan Reddy has been repeatedly denied bail on the specious argument that, despite being out of power, he might still have enough influence over officials to subvert their investigation. Compare this with the generosity towards coal minister Shriprakash Jaiswal, who is suspected of being complicit in the scam; he is close to the owners of AMR Iron and Steel Pvt Ltd, one of the beneficiaries. Jaiswal was not even shifted to another portfolio, let alone dropped. Officials in charge of files report to him. Should we be terribly surprised if CBI cannot get them?

Once there were double standards. We have raised the game to triple standards. But democracy has its own way of rescuing truth from a maze, and handing it to independent media, en route to the voter.
