[rti4empowerment] Role of RCS in Cooperative Group Housing Societies

Dear RTI Activists,
 
In continuation of my request for information, in reply to my RTI application ID no. 10393 dated 30.12.2010, to RCS, GNCTD, I havge received a reply as follows:
 
"You have requested to provide photocopies of affidavits submitted by 79 members of the Society to the President of the Society who in turn submitted
 to RCS before final drw of lots of flats.  The infomation pertains to Society record. The Society is not a public authority, hence your application
cannot be forwarded to society to provide you the information."
 
MY question is:
 
1. Is Registrar of Cooperative Societies, Govt. of NCT of De3lhi is not a public Authority? If it is, I have asked for information
which is with this Public Authority?   I have never said that you forward my RTI application to the Society.   
 
2. Is RCS office has no role to play as regards monitoring the activities of the Societies and seek RCS  permission by se3nding relevant documents including 
    members' affidavits for final darw of lots?
 
3.  I was the 80th member who was not allotted the flat. No reason is given by the RCS or the President of the Society
 
4.  If RCS has no role, why 27 Coop. Group housing Socieites of Dwarka which held  the draw themselves as RCS is not ready to send its representative 
    for the draw, should be given any notice for legal action against them? RCS is not ready to send its nominee for the draw despite Delhi High Court
    Orders and instructions of the Cheif Minister of Delhi.
 
On hearing from RTI activists, I shall give immense material of corrupt practices to the Movement of RTI as well as Fight against Corruption or
India Against Corruption the subject of todays' RALLIES all over India.

Long March from Nandurbar to Mumbai (500km) for the Right to Jal, Jungle, Jamin & Natural Resources

Tribal on North Maharastra has decided to make their protest at Mumbay in the front of assembly seeking relief and the fast implementation of Forest rights act, 2006 under the banner of Lok Sangharsh Morcha. About  5 thousand tribal men and women along with their children will be marching from Nandurbar to Mumbai by walk (Padyatra) with the distance of 500km from 1st March,2011. Padyatra will reach Mumbai on 15th of March,20011. Hundreds of public meetings will be planned on the way during the Yatra at several places to get endorsement of public/ civil society. Volunteers and a team of Doctors are also accompanied with the Yatra. Different mass organizations, political leaders, intellectuals and social activists will join them during the Yatra.
We are highly obliged if you make your valuable support to the struggle by joining us, by sending volunteers/ cultural teams, through publication materials, vehicles or in any other form you can consider better.

Now mafia can go to any extent to have its way and even murder the honest officers and whistle blowers. Oil mafia has burnt alive an honest officer Yashwant Sonawane, ADM.  Govt. has declared Rs 25 lakhs to the berevered family of the Mr. Sonawane. Seven persons have been arrested for the murder of ADM.

 

In an other incident, an RTI activist Mr Amarnath Pandey, 55, an RTI activist and homocopathy dotor was shot at.  In this case,, an FIR has been registered against three persons including a Block Development Offier.  Pandey has tried to expose corruption in development block Ghorawal due to which govt issued a recovery order of Rs. 30 lakh from the concerned officers for misappropriation of funds.  Last week also, Pandey was hit by a jeep when he was returning home on his scooter.  
Meanwhile, demanding immediate arrest of attackers, Congress activists staged a sit-in Jubli crossing creating traffic jam in the Sonebhadra area.


Superintendent of Police, Deepak Kumar said that police have launched a manhunt to nab attackers.

[rti4empowerment] Request for Information

Dear RTI Activists,
 
Cooperative Group Housing Societies in Delhi and other States have been allotted land for building houses at SUBSIDISED RATES. Office of the and position as Registrar, a State Government Officer has been created to monitor the activities of these societies. With this limited background, my question being put to RTI Activists is:
 
1.    Are these cooperative housing societies are not supposed under to seek permission from the Registrar of Cooperative Socieites for original allotment of flats through presence of his official after sending all relevant documents or its permission for transfer of flat to blood relations or third paerty for commercial gains by the Presidents of these Societies? 
 
2. In one R TI REPLY, RCS, Govt. of NCT of Delhi  has said that "information sought by you  pertains to society record. The Society is not a public authority,  hence your application cannot be forwarded to society to provide you the information".
 
I shall be grateful to Activists of their opinion whether RCS is simply show piece or has he has some responsibility in the affairs of these3 socieities?

Friends, It is absolutely sad that such events are taking place and the sufferer will render himself helpless at such situation.  The situation is grave enough to be taken easily.   The beswt solution to tackle such situations would be "not to handle the activism ALONE".  You have to build a team work, go in teams, every application for RTI infomation should be applied atleast a half dozen different members.   The object should be very clear that a single person should not become a target and an easy one.  Wisdom should take upper hand.  When authorities are contacted go to the highest authority in the department.   Have friends together whenever u go out on jobs.   This is only precaution. A loss of one Activist is a gain of 10 perpetrators. Caution is the word, regards dwarakanathdm

Now mafia can go to any extent to have its way and even murder the honest officers and whistle blowers. Oil mafia has burnt alive an honest officer Yashwant Sonawane, ADM.  Govt. has declared Rs 25 lakhs to the berevered family of the Mr. Sonawane. Seven persons have been arrested for the murder of ADM.

 

In an other incident, an RTI activist Mr Amarnath Pandey, 55, an RTI activist and homocopathy dotor was shot at.  In this case,, an FIR has been registered against three persons including a Block Development Offier.  Pandey has tried to expose corruption in development block Ghorawal due to which govt issued a recovery order of Rs. 30 lakh from the concerned officers for misappropriation of funds.  Last week also, Pandey was hit by a jeep when he was returning home on his scooter.  
Meanwhile, demanding immediate arrest of attackers, Congress activists staged a sit-in Jubli crossing creating traffic jam in the Sonebhadra area.


Superintendent of Police, Deepak Kumar said that police have launched a manhunt to nab attackers.

          The Department of Pension and Training (DoPT) is putting hard labour to limit RTI application to 250 words and allowing queries only on one subject at a time.  This is against the Act passed by the Parliament, which is the Supreme law making body.  If these proposals are implemented, these should be challenged in the Court of Law.

         

Moreover, many persons are capable to ask for more information on one subject even in 250 words than the information they may ask in unlimited words.  Moreover, the PIO or the Public authority will decide and define that the RTI is not on more than one subject and this will be open to widespread misuse.  A citizen does not have the means that something pertaining to an office is on the one subject or not.  This provisions are be misused by opening many files on one subject by sub-dividing the subject or by assigning a subject to many officers and innovative ways can be invented by the Departments to do so.  In the Delhi Municipal Corporation in some areas, the cleanliness of roads is the responsibility of one Department of MCD but the cleaning the sewer is of another Department and the removal of Malwa (construction waste) comes under the purview of third Department.  Even the cleanliness of areas in front shops immediately after the shops in Dwarka, Delhi comes under the Delhi Development Authority. Though, the subject is one i.e. "Cleanliness" but an RTI application on sanitation may and will be rejected on this score.  This is only an example and such instances can be found in thousands.  On the contrary, this will burden the Public Authority more as the applicants will be compelled to file over one application if they have more than one query.

 

The RTI has brought some qualitative changes and transprancy in the working of the government's departments to an extent but such proposals will negate this.  As far as argument of long RTI application is concerned, there is already a provision in the RTI Act that the information solicited should not disprosposnately divert the resources of the Public Authority. Recently, the Delhi High Court has also put a fine of Rs.75,000/- on Mr. Nijhawan of Paardarsita for unreasonable queries and after that, no such case has come to the fore.

 

Govt. should once more reconsider before rejecting the recommendations of the National Advisory Council on this.

They organise camps to promote bizarre concepts like "Use RTI avoid bribes". As a result the instituionalised grievance system of the PA lose its value and wither away. Ask yourself
