Messages from this RTI related forum go out to about 10,000 persons.

The "10 million" reference is about another of my social work
associations which is
not connected with RTI, (but with A) nation building as per Indian
tradition B) Elimination of corrupt persons).

As we can all sense, l and I'm sure nobody will deny it, the Indian
people are sheep who can be easily brainwashed, controlled by foreign
parasites, and easily led astray into wasting their time in blind
alleys and useless activities. (ie. "Lotus Eaters"). It is only our
Defence forces which have held the nation together (until now). After
retirement most of glorious IESMs revert to mean and indulge in Lotus
Eating activities.

If even 50 of our IESM members volunteer to send just 2 emails
(drafted by me) to babus (selected by me) ONCE a MONTH,  we will
witness change taking place before our eyes and in our lifetimes.

Screw social media and public battles - those are for Lotus Eating
NGOs.  Patriots execute covert actions against precise targets based
on proper intelligence.

For instance, I want 50 volunteers to send an email (which I have
already sent in my own name) to the Babus concerning how 8,000
Ministry of Defence computers were hacked by the Chinese and the babus
are still fighting over who will investigate the matter. No
investigation has taken place and 1000's of Top Secret files of Army
and Assam Rifles were sucked out of MoD computers and these computers
are still connected to the Internet leaking away to our Enemy No.1.

After this I want to send an email about a recent CONFIDENTAIL Cabinet
Secretariat project which re-employs retired babus at per-diems of Rs.
5,000 per day with stay in 4 star hotels in Delhi and regular to=fro
air tickets etc. The names of the people selected are an eye opener.

Respected Sir

Kindly inquire into and take the necessary action u/s 12 of RTI Act,
or otherwise, on my public grievance as is stated below. I would
appreciate an acknowledgment, within 5 days, of the receipt of my
grievance along with the tentative time frame to resolve it, as is
mandated by the DARPG/GoI scheme of public grievance redressal which I
am additionally applying under.

1) That Shri Rajiv Mathur in decision d/d 3.5.2012 uploaded at URL
http://www.rti.india.gov.in/cic_decisions/CIC_DS_A_2011_001055_M_81995.pdf
has failed to pass a reasoned order on the facts placed before him and
which were to be adjudicated upon by him.

2) It appears herefrom that Shri Mathur may not be fully cognizant  of
the provisions of the RTI Act which were to be invoked and has instead
proceeded to base his decision using a "seat of the pants" approach
and thereby transgressing well beyond the powers and duties of the
Commission as specified in the RTI Act.

Accordingly, I have reason to suspect that corruption is involved,
which requires inquiry. Alternatively, it may simply be a case of
ignorance which can be easily corrected by proper training to bring
his decision on par with those issued by,  say,  yourself.

Hence this grievance petition to protect the reputation and esteem of
the Hon'ble Commission and to safeguard the interest of the public at
large which includes myself as an RTI user...

has condoned the delay of over 30 days by the CPIO in replying to the
appellant and let the CPIO off without imposing the statutory penalty
on the trivial grounds ("pressure of work coupled with apology")
advanced by the private consultant who accompanied the CPIO. This
action is also contrary to several High Court decisions mandating
imposition of penalty in which Information Commissions were parties.

Accordingly, I have reason to suspect that corruption is involved,
which requires inquiry.

Hence this grievance petition to protect the reputation and esteem of
the Hon'ble Commission and to safeguard the interest of the public at
large which includes myself as an RTI user...

A few days back I happened to visit Nehru Palace to buy a computer/lap top n finally struck a deal with a dealer
to buy a lap top of Dell n asked him to load the required software, at the end of receiving the item when I saw the make etc at the bottom of the lap top I was surprised to see it as made in China.I objected to it n asked the dealer that I want an original/ genuine peace n not a china made, to my surprise he told me that it is a genuine peace n all lap tops of dell or even the other foreign brands r coming from china.this made me realise how china has gone so far ahead of us in economy n even foreign affairs.today all electronics, electric n computer related items in this country r either china made or Singapore or Korea etc so it is but natural that economy of these nations have moved too fast.The main point here is its side effects can be very dangerous while china being our no one enemy our all secretes can be passed on to china w/o much of efforts.Now another question is why our govt has allowed it is not understood are they not aware of its side effect in long run,in addition to damage to our economy what all else it can do? even most of our telecoms related equipments r china made today. I believe that china assemble all these items in every home of china,in fact this could have been the case in India since India was much ahead of China in home industry at the time of independence however destroyed slowly with govt's efforts to promote more large scale industries.

Tks for your Mail . the reason I posed a Few pertinant Queries is that By these Setreotyped Courses etc etc Certain Govt Depts are May be upto "certain Conditioning " of axctivists . this Conditioning may in a Later date Create certain Blocks on thier Independence in Thinking of what is Transperancy . Already An Attempt was Made by Defining "privacy" by a Few Info Comms.
Now OK , DoPT Conducts an On line RTI Course to All Citizens of this Country who are Interested or evince Interest . Let them also Give Grades . Is it similar to What AIR or DD considers Artistis . I think No . Since you have Undergone and Got a Grade it is You Yourself to Clarify the Same or DoPT. My Next Two Questions Remain and Follow .
The reason Being already There are Business Models ( I Do not want to Be Explicit for Best reasons)Erupting in Several states
Some by Retd IAS officers , Some by Serving IAS officers through Benami's , Some through NGO's . One Such Person Even Manipulated a KIC order that His Book on RTI full of errors is the only Means to Get Information(sic)
Ultimately ending Up with PIOs and PAs becoming Jombies
I am aware a Few Persons clandestinely Recurited as Advisors to a few PAs and it is these Advisors who Reply , attend FAA or Second appeal . If that is So what will the PIO do , Pay the advisor and Carry on all his Nefracious activity?
So in the Interest of Transperancy and Good Governance use of such Certificates or Gradations will Create Harm than usefulness

Dear friend May I clarify that you can not expect redressal of a complaint under RTI Act. Only querries are to be asked. Moreover you can not ask why, when whhere etc. Rather if you wish to know the details you can ask for the File notings and inspection of relevant file.
However I would suggest U to kindly go through my exhaustive book "TREATISE ON RTI ACT 2005" PUBLISHED BY M/S BHARAT LAW HOUSE , NEW DELHI with relevant Case Laws, Commentary and trick on asking questions. with FREE C.D. of various Supreme Court and High Court Judgements.

Secretariat project which re-employs retired babus at per-diems of Rs.
5,000 per day with stay in 4 star hotels in Delhi and regular to=fro
air tickets etc. The names of the people selected are an eye opener.

Mal-functioning of Odisha Information Commission (6)

Mr. Jagadanand, State Information Commissioner disposed and closed a Complaint Case No. 2532/10 on dt. 23.3.2012   taking into granted the submission Note filed by the PIO that the complete information supplied to the Complainant. But the information supplied by the PIO is found incomplete. Now the question arises what the Complainant will do and how will he get the complete information.  In Odisha , State Information Commissioners  never reopen the case  once  it is disposed and closed. Thousands of RTI Users are the  victims of   such nefarious practice  of Odisha Information Commission and deprived  of  getting  complete information.   

Dear friends

Mr. Motilal Mishra, RTI Applicant ( Mobile No. -  8908934368) of Bolangir  district  had  submitted RTI Application  on 5.10.2010  to the Public Information Officer, office of Community Health Centre / Primary Health Centre, Jamgaon , Bolangir seeking some information about  functioning of  Rogi Kalyan Samiti.  Getting no response  from PIO, Mr. Mishra  made a Complaint to  Odisha Information Commission on 27.12.2010.

 After  more than one year, Mr. Jagadanand, SIC(J)  heard the  case  on 19.1.2012,  directed  the PIO to provide  the  complete information  within 15 days  to the Complainant free of cost and  fixed  date 27.2.2012  for   another  hearing.  The copy of order was  received  by  the Complainant  on 19.2.2012.

 On 27.2.2012, Mr. Jagadanad heard the case. Finding no compliance report of his order  dated 19.1.2012, he  against instructed  to the Head of Public Authority  i.e., Medical In-charge  of CHC  to ensure furnishing  information and issued  show cause notice to the PIO  to explain  the delay caused  in this case  and put up the case  for further hearing on 23.3.2012.

 In the meantime, the PIO  supplied  the  information  to the  Complainant which  are  found incomplete. On 12.3.2012,  the  Complainant   informed to the  Commission  about  the  information supplied  by the PIO  and  demanded penalty  under  section 20 of the RTI Act.

0n 23.3.2012,  The  PIO  making  his appearance  before the  Commission   submitted that  he had  not received the  RTI application and  however  supplied the  information to the  Complainant  through registered post  at the  direction  of the Commission.  Mr. Jagadanand  did not  verify   the  document   to examine  the allegation of the  Complainant  and  submission of the PIO  that

a.       Whether  RTI application  was  submitted

b.      Whether the  information supplied  are  complete 

c.       Whether  the PIO    deserves  to be penalized.   Because in the earlier order, the Commission has issued show cause notice to the PIO.

 It was found that   there is no mention of penalty issue in the final order of the Commission. Though Mr. Jagadanand disposed the case on   23.3.2012, the copy of the decision was sent to the Complainant after 20 days i.e., on 12.4.2012 which was received by the Complainant on 25.4.2012.  Getting terribly  disturbed  having  seen the  copy of  final disposal of the case and getting   no complete  information  from the PIO,  the  Complainant  out of disgust  has  requested the  Commission on 2 9.4.2012  to reopen  the  case  and ensure  complete  information and impose  penalty on PIO  under section 20  of the RTI Act  for  causing  long delay  in supplying  information  

 

Let us see how Mr. Jagadanand  will  give justice  to the  Complainant.  This is  not  a single  case  but one of  thousand of  cases   in which  the  Mr. Jagadanand  has  disposed the cases  without ensuring the  information.

 

Wait  for  more  stories.
