[IAC#RG] THE RTI ACT MUST BE BOOSTED

The Right to Information Act which came into force on October 12th 2005 was enacted to ensure transparency and accountability in governance. But the manner in which the government has been subtly subverting the RTI Act is a matter of concern.

A well informed citizenry, transparency, and free flow of information are the very foundations of any successful democratic society. India may be publicly acclaimed as the world's largest democracy but the ground reality is that we are now ebbing away as Democracy and non-transparency in the functioning of the Government cannot co-exist.

Besides, freedom of speech without access to information is meaningless. In 2014 Narendra Modi rode to power on his vow of 'Acche din' for the Aam Aadmi and Good Governance. But once in power the Prime Minister has done nothing to empower the people by strengthening this vital Act. His then enthusiasm for freedom has over the years just waned away and we are in a culture of surveillance and secrecy. For the common man, getting correct and accurate information under the Right to Information Act is today still a far cry.

As the Right to Information Act requires that the Information Commissioners have to be persons of Eminence in public life, Independent minded persons who do not succumb to political pulls and pressures need to be appointed as Information Commissioners to ensure the proper implementation of the Right to Information Act. If Yes-men manage to creep into as Information Commissioners it would be an exercise in futility ending up as white elephants that we would rather be better off without.

Under Section 4 of the RTI Act all public authorities are duty bound to regularly display on their website a wide range of information, including all relevant facts while formulating important policies or announcing the decisions which affect the public. This proviso in the law was enacted to reduce the need for filing individual RTI applications. But this mandatory duty has been blatantly flouted by the authorities with most government websites themselves dysfunctional or not updated. What is the use of right to freedom of speech when the people do not have their rightful access to information?

The Judiciary needs to step in to ensure that the Government complies with the mandate of the RTI Act. But with the Courts themselves also averse to parting with information and with its functioning largely under a veil of secrecy, we are stonewalled.

But we need to battle it out and cannot allow the RTI Act to be choked by the government to a slow death. Steps need to be taken to strengthen the transparency regime that was sought to be established as envisaged by this Act. Effective implementation of the RTI Act requires political commitment from the very top. Officials denying information or giving misleading and distorted information need to be severely penalized.

Governance by cloak of secrecy and opaqueness needs to be strongly resisted. It cannot be a hush-hush regime. We need to dismantle those walls of secrecy that continue to hound transparency and good governance. In those very words of Narendra Modi 'Sabko sanmati de bhagwan' (Let good sense prevail).

The damage is already done.

The Constitution has already been subverted.

You can demolish a building in a few hours but it would take years to build it.

The Indian Constitution was preserved for over six decades. But now in the last seven years it has been subverted.  

Now Courts are imposing huge costs on petitioners bringing out just and true issues, just because the judges deciding the issues have no real knowledge of the issues.

The highest standards of judicial independence must be ensured by warding off even the faintest trace of governmental influence on the judiciary. The loyalty of every single Judge in our country has to be only to the very sacred Constitution of India.

[IAC#RG] INSTEAD OF RIBANDAR THE AYUSH CENTER CAN BE AT MANIPAL HOSPITAL RUN BY GOA’S BABA RAMDEV

The Old Ribandar Hospital which is Asia's first Medical school has a very glorious history. It was an excellent hospital and many of us were born there. The heritage structure was designed for it to house state of the art medical facilities which people from across Goa benefited.

The Old Ribandar hospital was an allopathic one and must so remain. It is deplorable that our Ayurvedic Chief Minister Pramod Sawant at the instance of Union Ayush Minister Shripad Naik with oblique motives wants to have a needless Ayush Center there.  

That proposed Ayush Center can be instead hosted in the Manipal Hospital at Dona Paula which is better known as a BJP hospital. The Ayush work there can be entrusted to the head of the BJP's Medical cell Dr. Shekhar Salkar, who illegally masquerades as an Oncologist though not qualified as one while the Indian Medical Association strangely has taken no action against him while allowing the lives of gullible patients to be in peril.

Needless to add Dr. Shekhar Salkar has also had an outstanding good financial bumper crop at the Goa Cricket Association and also at National Organization for Eradication of Tobacco (NOTE) which he heads. Those gross financial irregularities of he chewing public funds was even debated in the Goa Legislative Assembly. This known Cancer quack also doubles up as Goa's Baba Ramdev.

In recent years, almost every patient I have known who has been to Manipal Hospital at Dona Paula has faced a hell of a nightmare. Most of those patients have landed up in the morgue, with their families lumbered with massive and extremely exorbitant bills. For the family of someone already going through the pain of illness, it is added agony to being financially ripped off with very inflated bills. This anguish faced by the family members is heart breaking to have to collect a dead body and paying up that huge bill landing them in a deep financial hole.

Manipal hospital seems to be lacking any Code of ethics. A concern for the well-being of the patient is never there, while they merrily secure and pursue their commercial interests. The government ought to order an immediate inquiry into the dubious affairs at Manipal Hospital and the probe has to zero in around Dr. Shekhar Salkar who runs the commercial show there. He neither has a degree nor even a diploma in either Oncology or Oncosurgery.

Three weeks ago a 85 year old pious gentleman and close friend from Ribandar miraculously escaped from being butchered by Dr Shekhar Salkar who was all set for another five lakh windfall to operate on my friend who had a growth on his intestine. Luckily my friend who timely smelt a rat and the doctor's devious game plan, hastily sought discharge from the Manipal Hospital within hours of his admission there. Fortunately my friend sought immediate alternate medical advice and is keeping well after being successfully operated elsewhere.

Dr Shekhar Salkar has been grossly misusing his position as Head of Goa BJP's Medical cell to illegally and unethically rake up huge financial benefits for Manipal hospital while also enriching his own pockets. He should not be allowed to inhumanely and immorally gamble with people's lives.  There is abundant documentary evidence to the effect that the politically well-connected Dr Salkar has been unduly interfering and sabotaging the working of Government hospitals as well, only to benefit his Manipal Hospital.

Let us hope that our Health Minister Vishwajit Rane orders a prompt thorough inquiry into the blatant misdeeds and wrongdoings at the Manipal hospital. This financial exploitation of patients cannot be allowed to go on unpunished. We also need to know as to how that building on free government land which was a Goa Cancer Society hospital landed in the soiled hands of the Manipal Hospital entrepreneurs.

Instead of going to this Manipal Hospital, a patient may be well advised to die in peace somewhere else. At least the family's life savings would not be swallowed by this proven vulture of a hospital. The family will also be saved the financial ordeal and trauma they would have to go through after losing their loved one there, at Dona Paula.

[IAC#RG] FRUITLESS GOVERNMENT EXPENDITURE IS UNACCEPTABLE

Though the Government offices have resumed functioning to its full capacity, the very vital State Information Commission after remaining closed in May has now decided to resume hearing matters only in July.

The Chief Information Commissioner and the State Information Commissioner carry a very handsome monthly salary of Rs 2, 25,000 besides other perks. So is it not an unnecessary financial burden on the taxpayers to keep the Information Commission virtually dysfunctional citing pandemic as the reason.

The pandemic is here to stay at least for a while and we have to learn to live with it while all government authorities need to function with all the required precautionary and safety measures in place.

The new Goa Lokayukta has assumed office but has become a white elephant having been rendered toothless and powerless after the amendments brought to the Lokayukta Act in January this year

After  Justice P.K.Misra retired on September 17th last year the post had been vacant, so the relevant file notings if made public would reveal whether the government acted diligently to find a new Lokayukta and also as to how suddenly the name of Aurangabad based Justice Ambadas Joshi surfaced for consideration. Was it on account of his close links with the RSS?

The file notings if placed in public domain would also indicate the reasons why the government made the various amendments to the Lokayukta Act rendering the post a mere farcical one.

The Vigilance department which is the nodal office for the Institution of Lokayukta cannot keep all these crucial documents under a cloak of secrecy as it would amount to mischievously scuttling the very intent of the RTI Act which was enacted for Transparency and Accountability in Governance.

The all important Institution of Lokayukta and the State Information Commission are bodies constituted by law with specific and a clear mandate. A lot of public money is spent in running these authorities constituted to deliver justice to the citizens and bring to book the wrong doers. So they have to function in letter and spirit fulfilling the objective for which they are constituted.
