[HumJanenge] First Time: Need Help!

Dear Friends @ Hum Janenge,

Greetings!!

I am using this forum for the first time to seek help & guidance from all of you for a small issue that touches the lives of around 450 Families in a small but growing town called Thane in Maharashtra.

We live in housing complex of 13 buildings in the outskirts of Thane city near Upvan Lake. For approximately 3500 residents & adjoining settlements/gaonthan, we do not have a designated park or an open designated space.

We have an open space surrounded by our buildings designated as "Land for Displaced" with an area of around 3000 Sq. Meters in government records. This space has been slowly encroached by local shanties & a local builder has kept his men on the land.

However major portion of the land is still open & we want to use this as public play ground or convert it into a park for which the apex body is ready to contribute. Currently we are maintaining the remaining open space as a small ground.

I want to know:

1. How can we get rid of the encroachment using the RTI?

2. Can we use RTI to convert the reservation on the land from Resettlement for Displaced to Green Zone?

3. How can we force the local body which is Thane Municipal Council to atleast clear whatever is available & create a boundary around the space?

I am not evading the substance of your query "WHAT/WHY".

I will definitely answer that.

But before that could you please explain how RTI can be used against Govt. ?

Does Govt. mean any particular department, personnel or any PIO ?

Please explain how RTI can be used against Govt.? Do you have any action plan to use RTI against Govt.?
Does Mr. WED's mail empowered your member to use RTI against Govt.?

Further I'm really surprised that you obtained some information from IB sources relating to team Anna.

If those info were really gathered through RTI ( which I'm sure not) and credible enough why are you not lodging an FIR against Mr. Kejriwal?

Lastly you have still not co- related posing queries against team Anna and RTI empowerment.

If you read WED's original message, you will see that he has objected to purported statements Anna Hazare made on National TV to the effect that RTI should not be used by citizen against the government.

I can truthfully say that I have never used (or misused)) RTI to fix / suspend any Govt servant (honest or dishonest). I agree that RTI is used by many irresponsible people to fix / victimise honest Govt servants and I have openly spoken about / against this on many mailing lists. In particular I have spoken out against peoiple like Mr Arvind Kejriwal who gets foreign funding to misuse RTI to harass honest Govt servants and get them to spy for his (erstwhile) foreign paymasters.

[HumJanenge] Why was Prashant Bhushan bashed up ?

Here are a few questions (to which I know the answers) derived from IB sources <wink>.

1) Is it true that Prashant Bhushan does not owe loyalty to the Constitution of India especially India's territorial integrity ? Should dhe be prosecuted under various laws like IPC for his seditious views ?

2) Do Prashant Bhushan and his father (who incidentally was a long time senior Congress Leader and Minister) see eye to eye with 2 other RSS members of "Team Anna" ?

3) Was Prashant Bhushan bashed up as a sequel to the violence inflicted on his supporters who dared to ask a few inconvenient questions to Arvind Kejriwal (which incidentally Arvind could not answer) during a meeting in Hisar organised for Kuldip Bishnoi (late Ch. Bajan Lal's son).

4) Is Arvind Kejriwal running out of foreign money/ funding (now that Aruna Roy and her friends have abandoned him .. for the moment) and has turned to Babas, Swamis and corrupt politicans (from his hometown) to finance him in the best "swadeshi" traditions (ie. all "black" :) ?

5) .Is there anyone on this RTI list who is prepared to openly defend / speak for Arvind Kejriwal (and since he will not defend himself) ?

The purpose of RTI is not to seek information for the sake of seeking information but it should have some objective such as apprehension of some wrong doing or corruption though we need not disclose that. Information should not be sought to vex the authorities/PIOs as that will be the wastage of time of the officails. 

For the large number of RTI applications as stated by the Prime Minister, citizens are not responsible but the lethergic attitude of official and corruption are responsible.  With few exceptions, officials  who are not inclined to do a legitimate work within a reasonable time.  The other reason for larger number of applications, if any at all, is the corruption in the system which the RTI is revealing.  Today, if many ex-ministers and leaders are in jail, the credit to a large extend goes to exposure made with the help of RTI.  Many other leaders appears on the way to Jail for the corruption perpetrated in 2G stectrum and for other scams.  Two Babas along with a Swami have changed the sentiments.

Dear Hazare,
While I support your strife for Lokpal bill; I decry your comment on RTI as transmitted on TV today. Despite my respect & reverence for your age, I desire to make it known to you that RTI is an inherent,axiomatic,inalienable, fundamental right of every citizen in Indian demcracy. You have no right to advocate that RTI should not be used to vex authorities. Authorities exist at the pleasure of people & if they are vexed by RTI applications it is only  because there are commission &  or omissions by them not according to law. Neither you are a part of popularly elected government in Indian democracy nor of the opposition. Nor you are a representative of the people of India.
So, weigh your words before you utter them.

PPP Projects Viz RTI Act 2005

During RTI Convention 2010, it was opined that 'Public Private Partnerships' (PPP) projects ought to be under RTI Act 2005.
 
In this context on 04 January 2011, Shri Satyananda Mishra the Hon'ble CIC had written a letter to Shri Montek Singh Ahluwalia, Deputy Chairman of the Planning Commission. 
 
The said CIC letter was responded by Shri Montek Singh Ahluwalia on 14 March 2011.

My Take :
 
Since huge amount of 'Public Assets' are used by the Centre and State Governments for contracting PPP Projects... It is but natural that People act as Watchdogs to ensure accountability in the expenditure of PPP projects V/s benefits accrued to society at large.
 
Therefore while signing contracts the Centre & State Governments must ensure that the PROJECT comes within the perview of RTI Act 2005.
 
Now its Our Call:
 
 PLEASE SEND YOUR VIEWS/SUGGESTIONS BEFORE IT IS TOO LATE.
