My view. Harish Salve and Co will be back in business. They will challenge the jurisdiction of the special court and put in a plea in bar of trial. This may then get referred to the Supreme Court which may rule against its own jurisdiction. There is a jurisdictional problem whether we like it or not. If there is no civil liability and criminal intent is going to be very difficult to establish for several reasons (if the trial proceeds), then there is no case. PS Sarbajit, a factual correction. India is the largest importer of arms in the world. It is in seventh place as far as defence expenditure is concerned (45 billion dollars). Can't say I agree about not being prepared to defend ourselves. If so, then the entire lot of the present generalship should be sacked.

The first step was to bring them back. That seems accomplished.

The second step is to publicize the written assurances the Indian Govt has supposedly given to bring them back. Since the case is sub-judice the Indian Govt can give no assurances without the permission of the Court. Sonia Gandhi saying "all steps necessary will pursued" does not give carte blanche to Govt to givce such assurances.
In case of Abu Salem the Indian Govt gave some assurances to Portugese Govt also, but once he was here the dealth penalty is still very much on if he is convicted.

The third step is to closely monitor and question the functioning of the fast track court. Our Judiciary can and must be questioned, but not in a way which is easily deflected / ignored.

The civil liability is already over with the Italian Govt already having paid Rs 1 crore each to the families of the victims under a compromise.

The criminal case is much more difficult because India has no friends in this mess it has created for itself. There is an ongoing International War on Piracy, and India is badly isolated on this issue. All the so-called associations we are members of and host lavish functions for have been silent - SAARC, CHOGM, G-20, NAM and are not prepared to join India - because we are militarily weak despite spending so much money on arms - India is 7th largest client state for arms but our military preparedness is worse than Gabon or Sierra Leone's.

India does not have a single friend today on the UN Security Council. Our entire diplomatic apparatus and MEA is a complete fuck-up and waste of public funds. No IFS officer is prepared to go out on a limb, because, unlike the Armed forces or IAS, it is guaranteed that every IFS officer will retire as at least an Ambassador of some shit-hole country unless he does something monumentally stupid.

As with every criminal case, the tampering with the evidence has already started. Crores of rupees have been paid in Kerala and to the Congress (and through the Cathoilc Church) to falsify the evidence. We will be hearing all sorts of stories in the corrupt media about extent of India's territorial waters, fake ballistics, actual pirate boats, the Indian Navy and Coastguard will be painted as clowns and jokers etc. Now it is up to India's Courts to see through the haze of fog and deception. As IAC repeatedly said during the Delhi Rape case - India's conviction rate is an abyssmal 6%. The odds favour the Italians unless we tilt it back in ours

As I have mentioned one week back, Pt 1,2,4 have been done. Some have expressed doubts at that time. Watch for unfolding rest of the Plan.

The deal which is currently being worked out is like this :
1 Indian Govt will take a very tough stand, threatening to take aggressive steps to preserve National Honour. . Indian public is impressed.
2 Italian Marines are returned to India, bowing down to Indian Supremacy.
3 Fast Track Court is established.
4 India gives assurance of not giving death penalty to marines.
5 Italians manage all stake holders.
6 Court acquits the marines.
7 Marines go back to Italy.
8 As usual in such cases, Indian Public have memory loss Of this event.
9 All Is Well !!!
