[HumJanenge] TIME ALLOWED FOR SECOND APPEAL IF NO REPLY OF FIRST APPEAL

Delivered first appeal on 19th Dec. 2012 to Indian Oil under RTI Act. No reply, only an acknowledgement after a week. Now want to file second appeal but 90-day period is over 3-4 days ago. In case of non-reply, will my appeal with be within time or time barred now?
