Dear N K Handa,

To answer your query, I would just like to highlight parts of the verbatim in the section 5(1) of the RTI Act which is produced below

SECTION 5(1) OF RTI ACT
"Every public authority shall, within one hundred days of the enactment of this Act, designate as many officers as the Central Public Information Officers or State Public Information Officers, as the case may be, in all administrative units or offices under it as may be necessary to provide information to persons requesting for the information under this Act".

From the above highlighted section, one can easily make out that the enabling section 5(1) of the RTI Act intended only Officers of the said Public Authority who are posted in its administrative units to be designated as the "Public Information Officer". Hence an outsider, who is not an employee of the said Public Authority cannot be a "Public Information Officer".

Though it has been provided in the RTI Act that every public authority will designate public information officer(s) in its office, one of  my friends has raised a doubt by asking if an outsider (other than an employee of the concerned public authority) can be the public information officer. May I request for clarification.
