"NEW DELHI: The government notification constituting a joint committee
to draft the Lokpal Bill has been challenged in the Supreme Court. A
PIL filed in the Supreme Court said it was unconstitutional to have
persons who were not Members of Parliament in the drafting committee.
The Supreme Court should quash the notification as 'unconstitutional'
and 'ultra vires,' said advocate ML Sharma in his petition. "The
impugned notification is out of rule of the House which is empowered
under Article 118 of the Constitution and all committee for proposed
legislation is framed by the Speaker of the House only. Hence the
impugned notification is out of jurisdiction and unconstitutional and
is liable to be quashed with immediate effect," it said.
The five persons who have been included in the drafting committee are
Shanti Bhushan (co-chairman of the committee), his son Prashant,
social activist Anna Hazare, retired SC judge Justice Santosh Hedge
and RTI activist Arvind Kejriwal. None of them are members of the
either House of Parliament but were chosen after Hazare led a protest
demanding a Lokpal Bill.
The PIL sought a CBI or judicial inquiry into the conduct of co-
chairman of the drafting committee , Shanti Bhushan, and his son, and
member of the committee, Prashant, alleging professional misconduct as
they levelled allegations against several former CJIs. Shanti had on
September 16, 2010, declared in public that out of 16 former CJIs,
eight were corrupt and six had doubtful integrity. Bhushan had also
challenged the SC to send him to jail."
