Re: [IAC#RG] Smt Pratibha Patil saved Corrupt HC Judge Soumitra Sen.

In case of  HC Judge Soumitra Sen, before he became HC Judge, he kept Public Money in his personal account and thus indulged in corruption.

Having committed this confirmed corruption, due process to remove him from service as HC Judge needed to be followed.

That was the reason why he could be impeached notwithstanding the fact that many more deadly judicial sharks " 8 of 16 CJIs Corrupt" not caught -



Subsequent two more CJIs continue to sit on this PIL at Supreme Court to save the former CJIs.

I do not know how right you are about the calcutta hc acquitting sen. But unless a committee of judges of the supreme court recommends impeachment, such an action is not initiated at all.

Under Art 124(4) the house could initiate impeachment proceedings on the ground of proved misbehaviour or incapacity.

 

The allegations against Justice Sen pertain to 1953 when Advocate Sen was junior to Mr Somnath Chatterjee. Moreover Calcutta High Court had acquitted him of these allegations and thereafter he became judge of the Calcutta High Court and got elevated to the Supreme Court.

 

When the motion was debated in Rajya Sabha Justice Sen was not allowed to appear before the house thereby denying the principles of natural justice.

 

Why to blame Pratibha Patil? In fact she did the best in accepting the resignation of Justice Sen.
