[rti4empowerment] ALL INDIA RADIO, MISLED CIC AND COMPLAINANTS - BOTH?

PUBLIC AUTHORITY MISLED THE CIC-LODGE COMKPLAINT WITH POLICE FIRST AND THEN DO NOT CO-OPERATE IN FINDING THE MISSIONG RECORDS

 

          News Service Division, All India Radio, New Delhi on the direction of the Central Information Commission on my complaint first informed the Police that some documents are missing and then it informed that the entire file is missing. On the follow-up of complaint by the police, the Parliament Police Station sent a letter to the AIR for more details, one of its cop has also personally visited the Department but now, it is not co-operating with the Police.

 

          I asked the PIO if the Department has received any letter from the Police in this regard and if that has been replied, if so, please provide copies of both.  The reply was that I cannot question the nature and quality of action taken/ not taken. Moreover, in view of the CIC's decision in the case of Shri Jaswant Singh and others, I cannot raise queries about this starting with when, whether and why though I have not asked about the reasons of any decision on policy matter.

 

Some provisions of RTI Act:

 

Section 3- "Subject to provision of this Act, all citizens shall have the right to information".

 

Section 4 (1)(d) "provide reasons for its administrative or quasi-judicial decisions to affected persons"

 

No exemption under RTI Act such as provided u.s. 8(1), Sec. 9 and/or section 24 (1).

 

It appears that the CPIO has lodged false report that the record are missing and now has retired last month but how to prove the report is false and proceed with requesting the police to take action against the false complaint, though in his letter, he requested for an FIR on the CIC's order but police registered Complaint (NCR) as offence was non-cognizable. 

 

If the Govt. offices are ducking the applicants and CIC like this, what can be done?
