Worst CIC Wajahat Habibullah

The first Chief Information Commissioner was only appointed because of his loyalty to the first family. Known for his arrogant style, he was severely criticised by Delhi High Court for his egoistic approach. Habibullah was rewarded for destroying RTI by appointing as Chief Minority Commissioner of India

Next CIC AN Tiwari- Secretary DoPT

He only served for 3 months but could undo some of the damage done by Habibullah. Tiwari is a career bureaucrat credited with writing the Right to Information Act.

Then CIC S.Mishra - Secretary DoPT

It was during his tenure that Supreme Court observed that Information Commissioners were passing poor quality orders lacking judicial mindset. Mishra's response in interview to NDTV was to say

We have not felt handicapped even for a moment by lack of any judicial training. The kind of decisions we have to take here, we have taken them all our lives, when we were in government, in fact more serious, more complicated decisions. Here the decision making is about whether this piece of paper should be given to a citizen or not. Because what is information? Information is defined by law as a piece of paper on which something is written. So if somebody asks for a piece of paper, like a file noting or a letter or copy of a bill or copy of a document, this document, that document, all that you have decide here is whether it is to be given or not given. Very rarely do you come across a case in which application of mind in the sense of judicial mind is required. So that might be less than 1% of cases. Just for less than 1% of cases to argue that you need people with vast judicial experience is somewhat exaggerating the work or type of role we are discharging here.

Because of such babu mindset almost every important RTI decision is stayed by courts.

Next CIC P.K.Misra - Secretary DoPT

The Govt and BJP have decided that Pradeep Kumar Mishra will be appointed as next Chief Information Commissioner. They have taken this decision without issuing any notice or seeking applications for the post. Govt. only wants pliable person in such sensitive positions who know the tricks by which one ex-government officer will help another government officer to escape from goving information. A person who will never impose penalty on the bureaucracy so that he will get his posh bungalow in Delhi after retirement. Pradeep Kumar Mishra is such a person and it is fixed with Sushma Swaraj that he will be sent to the Central Information Commission. GOD SAVE RTI

What can citizen do to save RTI?

Section 12(5)of RTI Act
"The Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance".This does not mean that only Babus can be appointed

India's War Against Corruption will only succeed if honest persons experienced in fighting against corruption for years and who know the tricks of bureaucracy to deny information are appointed to the Information Commission. Anna has prepared a panel list of 5 such honest activist persons and send it to PM and demand that they and only they be appointed.
