Re: [HumJanenge] Full penalty for 4 CPIOs on one RTI application

If some ICs are soft, v r aggrievd on that count but if an IC is tough and implementing the RTI Act in letter and spirit, v make charges of corruption withoug doubt.
What is an ideal situation?

Dear Manoj

Thanks for providing us yet another instance of Shri Shailesh Gandhi's "INCOMPETENT CORRUPTION".

One the one hand in this decision Shri Gandhi says
"Only the PIO has been given the power to seek assistance from any other officer to provide information"

He then goes on to penalise 4 extremely junior officers who were routinely forwarded copies of RTI by the D/A (ie. DEALING ASSISTANT) of the  "Deemed PIO" from whom the assistance was sought by the actual PIO, and the said deemed PIO admits he never even saw the request for assistance from the actual PIO.

To cover up, IC(SG) treats (and penalises) even the D/A by treating him as a "deemed PIO"

To even a caual observer it is clear that the real PIO and the deemed PIO have paid somebody massively and ensured that only some petty officers have been sacrificed yet again at IS(SG)'s penalty altar (aka money making machjine)

Here is an interesting case on four separate CPIOs of being imposed full penalty of Rs.25,000/-. I am aware of a case where two CPIOs were penalized for delay of one single application. Is this the first time four have been penalized for a single RTI Application?

"the Commission finds this a fit case for levying penalty on Mr. Bose, Mr. Dabas and Mr. Jeewan Singh, Licensing Inspectors (West Zone) and Deemed PIOs. Since the delay in providing the correct information has been over 100 days, the Commission is passing an order penalizing all three officers `25000/ each, which is the maximum penalty under the Act."

"Note: The Commission penalized Mr. N. Nagraj, Deemed PIO & Licensing Inspector of `25000/- under Section 20(1) on 20/06/2011."

So is this the current records?
