subsection 19(3) reads as "A second appeal against the decision under
sub-section (1) shall lie within ninety days from the date on which
the decision should have been made or was actually received, with the
Central Information Commission or the State Information Commission".
Sub-section (1) here refers to 19(1). So a second appeal against the
decision under subsection 19(1) i.e. decision to appeal, shall lie
within ninety days from the date on which the decision to appeal
should have been made or was actually received, with the CIC or SIC.
As per this understanding, I have filed a number of second appeals
even on day 90 of the receipt of decision of FAA with SIC punjab and
CIC but none has been rejected on technical grounds.
