Are Indians still ruled by Britishers ??. If Not, then:
All the existing Colonial laws now applicable must be repealed immediately.
The magistrates/judges must not have Discretion. Discretion simply means arbitrariness/Dictatorship.
i am told - Arbitrary actions not allowed by the Constitution of India.
No jail for any body as long as the person is not running away from the court, except in case of murder.
Mere apprehension should not be the reason for detention/jail, except in case of murder.
Jail only after conviction, except in case of murder.
Except murder case - Question of Bond / surety /undertaking should arise only after conviction.
Release all under trials (except murder case) who have already been in jails for the max period prescribed for the crime committed.

I am afraid we are going off the tract on the subject of AK,s detention in jail.
AK had levelled corruption charges against R.Vadra, Gadkari and Reliance. When he appread in AAP KI ADALAT, he was asked if he had any proof and his reply was in positive. Then it was suggested that he should approach the court with proof and he responded that it takes a lifetime to get one case settled in court. However, the people named by him can go to court against his allegations.Prior to that Ms. Damania had raised this issue. Later on some allegations surfaced that Ms. Damania was involved in some land grab near Mumbai.
Mr. Gadkari thereafter refused the charge and sent him a legal notice for defamation and the court process was started. He should have given documentary evidence to court which he did not. This is my understanding of this issue.
2. Freedom of speech is subject to reasonable resptriction. It does not give you licence to kill someone,s reputation
3.Colonial laws have been adopted since 1947. There are many unjust laws and provisions, but the Parliament has neither repealed or amended them.
4. Sporadic objections are raised from time to time like the present one- but nothing comes out of it.
I had great admiration for AK inspite of S. Roy,s warning signals. But feel totally let down during the last 3 months.

It doesn't even require a defamation case to arrest a citizen and tie him up in court procedures.
If I have a friend in police I can get even NaMo arrested thus (of course now his SPG would not allow that!)
or atleast get a summons sent to him by a court! One journalist proved it by having a sting operation in a Gujarat court.
He got non-bailable warrants issued against the then Prez Dr Kalam and the CJI!
Under those circumstance ordinary citizens can only suffer the atrocious court procedures!

Under the colonial law continued by Nehru in India a citizen can be jailed very easily. The powers given to a magistrate are huge and were codified under the British. It is appalling that Kejriwal can be summoned by a court and jailed just for saying a politician was corrupt. To make a citizen run from court to court is so easy in India

I think there is some misunderstanding; he was not jailed simply for calling a prosperous politician corrupt. The defamation case filed by Gadkari is yet to be heard and decided. He was jailed for not attending the court in spite of agreeing to be present.V.S.SardesaiFrom: "Satya D hitaya123@gmail.com [hinducivilization]" <hinducivilization@yahoogroups.com>

I agree with Nalapat ji. This is not about Arvind Kejriwal, this is about Indian democracy. There is no reason to jail him for what he said. In defamation against public persons, they can always call a press conference and refute it publicly. That is the US law and I understand the same with Indian law.

refusing to post a bail bond, while missing out on the "lizard" viz a
magistrate jailing an individual for what in more robust democracies
passes off as fair comment about political leaders
