RE: [IAC#RG] Arvind Kejriwal in jail!

Folks :
I am also interacting for the first time to this group , although I am very old subscriber of India Resists group.

1. Ramon Abrol  and Sucheta Dalal ,both are correct and convincing in the facts and arguments.
 2. However, I add that as long as the law is on statute; all law abiding citizens have to abide by it. By this does not mean that one should go and succumb against the dictates of Conscience; but then go to a higher court and challenge the law. If failed at all levels then yes, the citizens and even courts can appeal the government to modify or delete such archaic laws soonest possible . But till it is done, can we defy the rule of law without  sharing its consequences?

Folks:
My first ever response on this group:
Its easy to cry wolf when someone else's name is at stake.
Ponder on this:
1. A lady in this group is called a Slut on social media such as FB etc. by a Nutty man/woman. Once, twice, many times. The circle of friends start doubting the lady's character. What shud she do? Keep quiet n face agonizing harassment? Or go to cops, lodge a complaint. The cops lodge a complaint but the Nut is out on bail in a jiffy. He reverts to his nasty stuff again.
2. The lady can do nothing.
In India, harsh punishment MUST now be given by way of imprisonment coz unlike d west we dont have laws of awarding high punitive measures.
In d west, Mr. Gadkari cud have sued Mr. Kejriwal and won millions under libel laws. In India, he cud win perhaps few hundreds, after 20 years.
No, ladies and gentlemen, no one has a right to fowl mouth another human and deride anyone's character publicly.
Jail v/s high punitive - thats d moot point.
Remember, today it is Mr. Gadkari facing Mr. Kejriwal's un-proven charge of character assasination on Mr. Gadkari. Tomorow it cud be on you or I. Lets have faith in judiciary especially when it actually metes out justice.
Best wishes,
Ramon Abrol,

Absolutely agree with Mr Nalapat. Whatever ones views, the demand to post bail in criminal defamation must go! No sensible country has criminal defamation anymore, where even fair comment makes you an "accused" who needs to be let out on 'bail' just because someone has the time and inclination to sue!

It is unfortunate that the (colonial-era) laws are such that an
individual can get sent to jail simply for calling a prosperous
Politician corrupt. Whatever one's views on Arvind Kejriwal, his
incarceration will have a chilling effect on freedom of expression. The
Indian media,as is its won't,has chased the "lizard's tail" of Arvind
refusing to post a bail bond, while missing out on the "lizard" viz a
magistrate jailing an individual for what in more robust democracies
passes off as fair comment about political leaders
