Re: [HumJanenge] DISCLOSING LEGAL ADVICE RECEIVED BY CIC

Besides pensions, retired officers also receive medical/ health benefits, LTC (4 year block) etc. CVC has been known to impose penalty sometimes including reduction or even stopping of pension, forfeiture of property etc on officers as well as other subordinate staff found guilty in various matters on corruption, so how can retired CPIOs escape penalty Under Section 20 of the RTI Act 2005?

Please examine cases of major penalties imposed by the CVC in January 2009 at following link

and January 2011

You may also take up the issue if PAs deliberately appointing soon to be retiring persons as PIOs to game the system on penalties.

Lastly you may mention that for at least 2 or 3 years after retirement the officers are generally liable to be prosecuted for their actions (incl. omissions)
