                                                          WHY  CONFUSE  STOLEN NEWS / FAKE NEWS WITH FREEDOM OF SPEECH ?

 

An English newspaper published from south India, which is largely perceived to be anti Prime Minister Narendra  Modi in publishing news and views ,  has prominently published some news item regarding the Rafale deal.  Newspaper claimed that the matter has been sourced from the concerned ministry of Government of India and it has said that " no force on earth can make the paper reveal the source of news".

The matter was taken to the Supreme Court by an  activist known for being vocal in expressing opinion against Modi government.

 Government of India, in it's response , said that the matter was stolen from the ministry by adopting dubious means and such stolen matter cannot be admitted by the Supreme Court  to take up the issue for hearing. However, the Supreme Court rejected the contention of  Government of India  and said that any news already in public domain can be admitted for hearing by the court and  judgement  given in the due course of time. Almost every media in the country, including the English newspaper which published  the stolen news , welcomed the Supreme Court's  judgement and said that the verdict is a victory for liberty of the press and freedom of speech .

The verdict of the Supreme Court has certainly sent confusing signals amongst the people across the country  and some people have even said that this could be a dangerous signal, that may make the media go astray, publishing all sorts of news and views , true or otherwise , with least sense of fear ,  caution and responsibility.

In India today, most of the media houses are owned by business men or political parties or politicians . The distinction between the media houses and business houses are losing clarity. In the same manner, the dividing line  between politicians and journalists are also becoming very thin. Most of the journalists seem to have firm political views and are no more neutral and objective in interpreting the developments .

It is well known that fake news are being planted by vested interests and fake photographs are publicised , which are prominently published in section of media  without proper verification or with deliberate  and  mischievous motive .  In such situation, the faith in the media,  both print and visual media , amongst people are rapidly sliding down. Many people believe that media today is no more the media that people knew of in the earlier days immediately after independence.

It is common these days to read news and views in the media stating "our sources said". The real source is never indicated and one would not even know whether any source of news exist at all or it is only the figment of imagination of the editor/journalist.

Media certainly need check and control and it is dangerously now moving towards the trend of publishing motivated and false news.

One would have thought that the learned judges in the Supreme Court of India would have thought more carefully about the long term implications of  it's above verdict . In recent times, we have seen many occasions when the judgements of the lower courts  are over ruled by the higher courts and the judgements of higher court  themselves are changed or revised or nullified by the same court later on. One only hope that Supreme Court would re consider it's verdict , keeping several implications in mind.

It would have been more appropriate if the judges have ruled that any matter published in the newspapers and media should contain information about the source of information and data and if not, it would be a punishable act.

It is shocking that none of the senior journalists in India have objected to the above verdict of the SupremeCourt ,almost justifying the statement of the newspaper that it would not reveal the source of information.

In the earlier days, when India had journalists with courage of conviction and better objectivity, atleast some journalists would have raised objections to the above verdict of Supreme Court which make it look that limits and freedom of media is endless and boundary less.

[IAC#RG] National Testing Agency

Sir

I refer to my visit to your Department's offices at Shastri Bhawan today morning when I was not allowed inside your buildings to meet the concerned senior officers of your Department, or in their absence yourself, concerning my complaints about blatant rigging of the IIT JEE Mains 2019 exams, and other exams, by the National Testing Agency under your protege Mr. Vineet Joshi, IAS.

I presume that you, an IAS officer, are sufficiently informed that today is a Wednesday when the morning session is set aside for senior Central Government officers, including yourself, to receive and hear the public and their grievances. You have also been required to ensure that Wednesday mornings are meetingless days when senior officers should remain inside the offices unless written permission is obtained from youirself, and also that the citizens do not need an appointment to meet their senior functionaries.

In these circumstances I would appreciate a formal reply within 48 hours communicating why the Nodal Grievance Director Mr.VLSS Subba Rao was not at his seat to meet me, Why the Addl Secy (TE)  Dr. S.S. Sandhu was not at his seat to meet me, and why your PS Ms. Krishna did not allow me to meet you, either in the pre-lunch or post lunch sessions today concerning my grievances and their shoddy disposals (in blatant contravention of the PMO's specific directives) to shield corrupt officers.

In the meantime I am putting on record that your PS Ms Krishna informed me today as follows

(1) You would not meet me today because were in a meeting,

(2) I needed an appointment to meet you on Wednesday morning and

(3) That you are no longer the Chairman of NTA's BoG but Prof M.S. Ananth is.

Since I find nothing in the public domain about Prof Ananth being the NTA Chairman, in fact the NTA website persists in sayiing you are their Chairman, I am hereby protesting the alleged appointment of Prof M S Ananth as Chairman of NTA, if at all, in this underhand / secretive manner and your evident attempt thereby to evade personal responsibility for the scams in NTA and the frauds played out on the innocent students.

Furthermiore, since all the facts are surely well known to you now, I trust that you shall do your duty to immediately suspend the results of the IIT JEE Mains exams of January and April 2019 and not allow any admissions into any Centrally Funded Institutions under youir department based directly on the scores of these tainted exams.

NB: In the interests of transparency, I am obliged to mark a copy of this email to Prof Ananth.

ENACTMENT - RAJASTHAN SOCIAL ACCOUNTABILITY BILL, 2018

Thanks for the steps taken by you to heal up the wounds given by Bureaucracy of the State to Public in General, and specially to weaker sections. But I have a little different view on the subject looking to the outcome of the laws passed by your esteemed Government earlier, and the benefits to public.

You had enacted The Rajasthan Right to Hearing Act, 2012 and Rajasthan Guaranteed Delivery of Public Services Act 2011 which gave no virtual solace to public except performance of some rituals. You will please agree that Bureaucracy of the Country functions in a purely autocratic manner, and do give nothing to public in the name of relief. One has to run from pillar to post for redressal. The misuse of protection given by Constitution and Section 197 of Cr. P. C. are the greatest hurdle in visualizing true democracy. No such immunity is available in other democratic countries like US, UK etc. since it offends the Right to Equality- the very fiber of Constitution. The Bureaucracy has a very tight but strong grip on the democratic tools in India. No public voices are heard and they turn total blind eye to public grievances unless forced by hook or crook. The bureaucracy has turned out an unbridled horse. The acts enacted earlier by you have turned merely show pieces and redundant for public. Government of Manipur has also enacted "Public Servants Liability Act, 2006" earlier.

The hierarchy of the Government Machinery protects each other and no relief is given in general by any superior authority in appeal against any unlawful order, fancy, vices or whims of a junior. The juniors are the earning instruments of the seniors. They function in a league to protect each member of this DON EMPIRE.  Otherwise enactment of such law was not desirable at all since the superior authority might have granted relief in even administrative capacity. They are bound by ties of a kind of brotherhood. (े सभी आपसे में पेटी बंद भाई होते हैं)

I would like to say that section 85 of the proposed Act which extends protection for acts done in good faith is unnecessary and uncalled for. The acts done in good faith are already protected subject to limits and the public servants do not deserve to any such blanket protection. Instead it, the section must be replaced or alternatively a new section to read as under should be inserted in the Bill to give relief in true sense.

85. (1)  All the Public Servants functioning or purported to be functioning under the Act will be responsible for propriety, lawfulness, fairness, timeliness and correctness of his all actions, inactions, orders and decisions taken by him.

      (2)  A public man aggrieved from any improper, unfair or unlawful action or decision of any public servant under this Act will be compensated by Government adequately.

     (3) Government reserves right to recover the compensation money paid under section 85(2) from the delinquent public servant.

 

I think you will please find my suggestions helpful in strengthening democracy at least in the state otherwise the proposed bill in the present form will not be helpful to any citizen.

 

I shall be glad to know the action taken by you in this behalf.

  प्रेम शकर झा, जो की एक सम्मानित पत्रकार  हैं ने लिखा है, कि सरकार के पास पुलवाना हमले की जानकारी थी. (ठीक उसी तरह जैसे गुजरात सरकार के पास गोदरा हमले की जानकारी थी) किन्तु जान बूझ कर इसे होने दिया गया (जैसे गुजरात में होने दिया गया). प्रेम शकर झा के अनुसार एक नहीं दो सूत्रों ने हमले की आगामी जानकारी दे दी थी. विश्लेषकों के अनुसार हमले से होने वाले चुनावी फायदे के लालच में सरोबार भारत के सबसे बड़े देश भक्त ने CRPF के जवानो की बली चढ़ा दी. भारतीय राजनीति की विशेषज्ञ आसीमा सिन्हा ने अपनी फेसबुक पोस्ट में लिखा है.    Prem Shkar Jha is a very serious journalist. His claims about how the government may have prevented Pulwana but did NOT, need to be taken seriously. मुझे अपने देश से प्यार है. लेकिन क्या देशभक्ति के नाम पर वोट मांगने वालों को है? तो ये पूछना जरूरी है की पुलवामा कैसे हुआ? अगर ऊपर विशेषज्ञों ने जो कहा वो गलत है, और सरकार को सचमुच इसकी एक या दोदिन पहले कोई ख़ुफ़िया जानकारी नहीं मिली और हमले के दिन भी सुरक्षा तंत्र को ये आभास तक नहीं हो सका कि कोई आदमी कश्मीर की सड़कों पर एक हजार किलो बम्ब लिए घूम रहा है, और CRPF के कारवां की तरफ बढ़ रहा है... तो फिर देश सुरक्षित हाथों में कैसे है? ......... चुनाव जीतने के लिए के CRPF के जवानो को मरवा देंगे..
