Re: [IAC#RG] MANOHAR PARRIKAR – A CHEAT MINISTER?

Agreed, but there might be other reasons considering the man is still critically ill.

Mr. Rodrigues, one thing I must appreciate about you is that you don't have one good thing to say about the present central Govt and  BJP ruled states and make it seem like everything in this country has just about gone wrong since 2014 and till that time our country was a superpower, no terrorist attcks, no intelorence, safe roads, freedom of speech , inflation was under control, business s were flourishing, employment for everyone and so on.

It's time people make their own informed decisions based on facts and figures. We should Stop misleading people with posts that create an environment of hatred. Well travelled people and people who have stayed in some of the most conservative country's will admit to this fact that India is one of the most peacefully run country despite its such a diverse population with multiple religions, castes , creed, culture s etc.

[IAC#RG] COMPLAINT # 2 : Re: RTI Online - First Appeal Disposed Of.

SUB : COMPLAINT # 2- Selling of IIT seats under Vyapam model

Further to my email of yesterday and referring to your RTI appellate order dated 14.12.2018 to my appeal. I am still to receive any reply from NTA for my long overdue RTI request.

I am highly aggrieved that despite being a public servant and member of Governing body of so-called NATIONAL TESTING AGENCY (NTA) and having personally issued an ORDER dated 5.September.2018 titled as "Creation of National Testing Agency (NTA) for conducting entrance exams for higher educational institutions" you deliberately did not provide me any information under RTI from the records of your own section concerning how, why or when this National testing Agency (NTA) was created or how exactly Shri Vineet Joshi, IAS was selected to head it as Director General.

From your own order (which some helpful private soul has sent me today), it is clear that this so-called NTA is a Cabinet routed fraud on the citizenry which has no statutory backing at the present time and is being financed under the same fraudulent "Money Bill" mechanism used for imposing Aadhar to avoid any parliamentary debate and discussion. It is also very unclear now after the Hon'ble Supreme Court has rejected usage and storage of biometric data without statutory basis how the NTA plans to impose collection and storage of biometric data of examinees by the private vendors. It is trite to say that AADHAR based biometric data collection / authentication was an integral security feature of NTA to prevent the kind of impersonations taking place under the VYAPAM model. 

I am therefore again calling upon you as a member of NTA's Governing body to ensure that there is no possibility for rigging of the IIT JEE Mains online exams and that the NTA is fully RTI compliant well before any exams are conducted by it so that concerned expert citizens likely myself can satisfy ourselves under statutory process that there is no hanky panky possible in these exams.

I refer to your rti appellate order dated 14.12.2018 to my appeal.

It is astonishing that the MHRD does not have any information to
provide me on how, why or when this National testing Agency (NTA) was
established or how exactly Shri Vineet Joshi, IAS was selected to head
it as Director General. Perhaps this is another one of those infamous
PMO decisions originating from Vivekananda Foundation pushed through
Cabinet which are later rubberstamped on back date by your Ministry.,

It is more astonishing that NTA while evading complying with its
STATUTORY RTI obligations is pressing ahead with conducting the JEE
Mains exams by involving computer organisation/s from Indore (centre
of Vyapam scam) whose director is associated with the BJP and also a
notorious foreign intelligence organisation. It is atrocious that this
private organisation has been allowed to create and access numerous
login records (which include the email IDs) of candidates for this
exam by Mr. Vineet Joshi.

Now, since I have not received any information till date to my request
despite your appellate order, and I have clear reason to believe that
the NTA is established to be a single point window for corruption in
entrance exams involving selling of IIT seats and later medical seats
under the Vyapam model. I would therefore request you and the IIT JAB
to kindly satisfy yourself fully that there is no scope for rigging of
NTA conducted computer based exams in any manner, since I have
indicated many examples of how this has been achieved in the recent
past using Information Technology..

[IAC#RG] Another flawed order passed by NHRC based on perpetrator police report. NHRC case no. 1435/25/11/2017

Protest against the direction of the Commission

 

Respected Sir,

I have received Commission's direction dated 21.12.2018 in connection with the above referred case. From the direction it is revealed that your authority closed the case based on the police report and therefore the Commission said that the police authorities have taken requisite action by registering the cases and have submitted charge sheets in the concerned courts, thereby no further intervention by the Commission is needed.

Being the Secretary of MASUM, I beg to submit a strong protest against the direction of the Commission in the following points:-

At first, from the direction of the Commission it is clear that before closing the case your authority did not concern about the torture which was committed by the police authorities upon the victim. The power loving police forces continue their crime work and later they concocted the story by changing the fact and enter the name of the victim in false criminal cases. In the direction the Commission never says a word about redressal of the torture inflicted victim by the police authorities. I think your authority forgets in which purpose NHRC was established? I again reiterated the fact that the Commission was established to protect the common people from the atrocities of the state authorities.

Secondly, in the police report dated 04.01.2018 submitted by the Superintendent of Police, Malda, there are various anomalies which should be mentioned:

(a)  The enquiring officer Mr. Bipul Kumar Majumder, Dy SP (HQ), Malda, during the time of enquiry did not record the statement of the victim. Even he did not produce the medical injury report and the statement of the doctors at Silampur R.H and Malda Medical College who were treated the victim at that time. The basic principle of investigation "audi alteram partem" is violated by the enquiring officer in this case. Such kind of enquiry is a biased enquiry to protect the skin of the perpetrator police personnel.

(b)   On 08.08.2017 Ms. Rekha Bibi, the sister in law of the victim submitted a written complaint before the Superintendent of Police, Malda stating the incident of police torture committed upon the victim by the perpetrator police personnel. But the enquiring officer did not examine Ms. Rekha Bibi during the time of his enquiry. The enquiring officer did not bother to render any clarification regarding what action was taken by the Superintendent of Police, Malda till date on the complaint of Ms. Rekha Bibi.

(c)  The enquiring officer did nothing during the time of enquiry except retelling the information available in the police record in connection with Kaliachak Police Station case no. 546/2015 dated 07.10.2015 and Kaliachak Police station case no. 560/2017 dated 08.08.2017 and Kaliachak police station GDE no. 351, 345, & 370 dated 08.08.2017. I do not know on the basis of such sole reliance on the police record, how did the enquiring officer declare that the allegation made by the complainant was baseless and motivated?

(d)  It should be remembered that West Bengal Police is guided by the Police Regulation of Bengal, 1943 for effective functioning. Regulation 262 of the Police Regulation of Bengal, 1943 enumerates; "Directly an accused person is placed under arrest, the investigating officer shall ask him whether he has any complaint to make of ill treatment by the police, and shall enter in the case diary the question and answer. If an allegation of ill treatment is made, the investigating officer shall then and there examine the prisoner's body, if the prisoner consents, to see if there are any marks of ill treatment, and shall record the result of his examination. He shall further consider and note whether there is any reason to believe that marks found are attributable to other causes than ill treatment and shall record the result of his examination, such as resistance to arrest. If the prisoner refuses to allow his body to be examined, the refusal and reason therefore shall be recorded. If the investigating officer finds that there is reason to believe the allegation of ill treatment, he shall forward the prisoner with his complaint, the record of corporal examination, any other evidence available, and if possible the police officers implicated by the prisoner's complaint, to the nearest Magistrate having jurisdiction to enquire into the case." Under the mandate of the said regulation the police is duty bound to ask the arrestee whether he has any complaint to make of ill treatment by the police and shall enter in the case diary the question and answer. But in the police report the enquiring officer failed to report whether the said mandate of duty was duly discharged or not by the police of Kaliachak police station.

(e)  Such kind of enquiry is not a neutral enquiry at all. It is merely a table work to give a clean chit to the perpetrator brothers. It is also undermined because the enquiring officer as senior brother, during the course of his enquiry completely failed to recognize that the police records may be manufactured to suit the interest of the perpetrator police personnel.

But your authority overlooked these types of lacunas which are very much predominant in the police enquiry report and the Commission closed the case completely depending upon the police report submitted by the Mr. Bipul Kumar Majumder, Dy. SP (HQ), Malda.

Thirdly, the Commission contended that as the charge sheets have been filed and the matters are sub judice before the concerned courts, no further intervention is needed. It should be remembered that NHRC is a quasi judicial body and a watch tower over all types of violations of human rights. So it has jurisdiction to run the case after knowing the matter was sub judice. There was a vast difference between the court proceedings and NHRC proceedings. But your authority closed the case depending upon a mere ludicrous matter.

The matter is grave and serious one as the incident of violation of set procedure of law at the time of arrest and custodial violence committed upon the victim by the perpetrator police personnel of Kaliachak police station. The allegation is straight against the representatives of state authority but your authority completely believed upon the report of the same department. From this working procedure it is to be believed that the NHRC and the state authorities are hand in gloves and thereby try to juggle with the justice of the poor, common people of the country.

I again demand justice and send this protest against the direction of the Commission and therefore request to reopen the case for a neutral investigation by your independent agency so that the victim may get an opportunity to place his voice and his records to substantiate that he was subjected to custodial torture by the power loving police authorities.

Sub: RIGGING of IIT Jee Mains online exam from January 6th 2019 onwards

I am caused to send this communication to you because you appear to be the ex-officio Chairman of the so-called NATIONAL TESTING AGENCY ("NTA") whose COMPUTER BASED EXAMS I am convinced shall be rigged and manipulated like some past government conducted exams like SSC-CGL 2017, CLAT 2018, AIIMS and also the various offline CBSE Class 12 exams of 2018 had been under the present Central government.

The cause of action for my sending this email to you is that I now have reason to believe that the NTA is established to be a single window for corrupt entry through prestigious entrance exams.

The public has not forgotten the political elements who were behind the VYAPAM entance exam rigging scam in Madhya Pradesh / Indore and it seems strange that the NTA seems to have granted key contracts to persons from Indore and thereby granted them mandates to run insecure online exam centres all over India where online exams will be held. You may thus kindly urgently inquire how a member of BJP's online IT team hailing from Indore has been awarded some contracts by NTA and is in a position to know all the personal particulars of the serious registered candidates for JEE Mains exam, and which may easily be misused to approach them for corrupt purposes.

It is pertinent to inform you that my overdue RTI request and a further RTI first appeal (Reg. No. DOHED/A/2018/60365 disposed on 14.Dec.2018 by Shri Prashant Aggarwal - Director (IITs) of your department) have still not proivided me any information whatsoever concerning why, how and by whom the so-called NTA has been established and given the sole mandate to conduct all the major entrance exams for India, and why the NTA is not RTI compliant even till date.

I am further concerned / alarmed to learn that all the data records including keyclicks of these exams will be hosted and stored on private data centres and these (ordinarily public) records have been directed by Shri Vineet Joshi's orders to be destroyed very soon after the exams are conducted.

It is further pertinent to inform you that I am still to be informed about the counter-measures for the various cyber security concerns which I described in my RTI request. Nor have I been informed how Mr. Vineet Joshi came to be selected as the Director General of the NTA. I need hardly remind you that Shri Joshi's suspiciously long tenure in CBSE was marred by several controversies in the conducting of the CBSE Class 12 exams and the JEE Mains / AIEEE exams.

Accordingly, in the face of the deliberately evasive attitude of MHRD and NTA to inform concerned citizens like myself how the the JEE Mains fully online 2019 exams are being conducted securely and to ensure fairness and transparency, I am constrained to publicly claim that the JEE Mans 2019 computer based exams appear to be rigged, with the hope that good sense and decency shall prevail in the Government of India.

This is a snap book review by IDF of BLUE WATERS AHOY (Harper Collins 430 pages ISBN 9-789553-025526430.

 The voluminous 430 paged chronicle is printed with high resolution pictures in a coffee table form and is freely available on the net on https://www.indiannavy.nic.in/links for Maritime Beavers to appreciate how Indian  Navy became a Force to reckon with and is rated number  5 in the world. The book explains the ingredients of its rise.

 

India Defence Forum (IDF) has a confession to make. The book is long but as it has many professional features that Naval officers of yore started and the Admirals of the decade 2001-10 have taken forward, it was a pleasure to rush through the chapters. It surprises many to learn how Indian Navy carries out 24 major exercises annually, maintains advanced ships in crowded infrastructure, fires powerful Klub and BrahMos missiles and shows the Flag around the world with succor in HADR and control piracy and how Naval Wives in NWWA help.

Navy recently assured the Nation it is part of India's Triad and how all this came about is in the book as the organizational aspects are in the book in detail in well arranged chapters. The decade 2001-10 in the book does justice to Navy's achievements and former Navy officers and men  are assured the Navy is on course despite low budgets, discussed later.

Admiral Sunil Lanba, Chief of the Naval Staff, released 'Blue Waters Ahoy' authored by author Vadm Anup Singh who sailed against IDF as young budding Lt and retired as the Flag Officer Commanding-in-Chief of Eastern Naval Command. He presented the book to the President Shri. Ramnath Kovind, also India's Supreme Commander at Navy House on Navy Day which falls every year on 04 December to commemorate Navy's heroic offensive actions during the 1971 war which hastened formation of Bangla Desh. IDF reiterates 4th Dec  should be Armed Forces Day as India does not have one, and IAF also took part in the raid on Kemari tanks on 4th Dec 1971 and Army went into action into East Pakistan and the Mukhti Bahini navigated their historic military advance to Dacca to free the East Bengalis and make Pakistani Armed Forces to surrender. Dignitaries and foreign Attaches were present at the function. This unique undertaking by the Indian Navy can be traced back to 1968, when the Service established a History Cell.


Very rightly CNS Adm Sunil Lanba a Navigator like Adm Anup Singh records. "To seafarers, chronicling history is of social significance since the sea leaves no tell tale marks for those who follow. There are no forts or ruins to tell a story". 

This book is gold and the experience of CNS Adm Sunil Lanba who commanded two commands and NDC and Anup Singh shows it as they were hands on in the period and feel is very important for a historian. IDF also tried and has tried again in Novel AN UNDERHAND AFFAIR due out in January.
