[HumJanenge] General Superintendence of Mr Shailesh Gandhi in File:CIC/SG/A/2011/002543

Respected Sir

I am aggrieved by certain recent decisions delivered by Shri Shailesh
Gandhi acting independently, and which I believe require his
superintendence u/s 12 of the RTI Act.

I am unable to understand how Mr. Gandhi in his order in the above
cited matter has ignored numerous decisions of this Commission,
including Full Bench decisions, concerning the "fiduciary" nature of
information held by Scheduled Banks in the course of conducting their
business and instead chose to focus on the :absence of :"larger public
interest" to justify disclosure of information sought. This is the
reverse of another decision of Mr. Gandhi's (now.before the the High
Court and stayed) where he agreed that information with the Bank was
fiduciary in nature but had to be disclosed due to the larger public
interest involved. The RTI stake-holders are getting increasingly
confused by the contradictory orders emanating from Mr. Gandhi's
Registry especially when well settled Full Bench decisions are being
given the go by so casually..

In the circumstances, I request you to kindly examine the record in
the above file. as I also have reason to suspect that by using the
device of video-conferencing it was ensured that evidentiary
submissions of the Respondent were not properly / fully recorded and
that this done corruptly..

As this is a recent decision, I hope that the recordings of the
video-conferencing are well preserved so that desirous citizens may
inspect / obtain the same in RTI process to get the concerned
Commissioner prosecuted if the Commission as a body takes no action
against a member of it's collegium..
