Sir-Last month I was shocked to hear from Principal of secondary school (CBSE) that Aadhar Card is mandatory for Primary students So I asked Education Dept whether any GR is issued by Maharashtra Govt to which I was informed YES -and cited GR of july 2015 -After hearing from Education Dept I did apply thru centre  appointed by Govt which charged me Rs 30 (Official charges are Rs 2)
This centre is well managed by BJP activist -you enter the Centre -you meet with beaming  Modi's photo
Nothing more to add ------Next 5 yrs BJP will have complete details of not only adults but kids -and we wThis centre charged Rs 100  we have NO control  how/where data will be used/misused -
BJP has certainly provided Employment to their ardent followers One centre is located in most dirty/filthy area -and it's so cramped that citizens have no space to stand so lady sat on stool kept on gutter .Biometric machine had to struggle to take finger prints -may be it was junk

I am resending my comments of 9/1 on Aadhar issue with further comments / clarification as under –
 
1} When UPA tried to give it a legislative protection, NDA did not allow it. This situation continued till 2014 election.
 
2.  That in 2016 the present Government has passed an Aadhaar Act as a Money Bill to bypass Rajya Sabha.  In my opinion it is a fraud on Parliament because the Parliament Committee which examined the UPA legislative proposal had made scathing comments and stated that it should be discussed and passed by Parliament in both houses.
 
3. Whilst passing the Bill in the Lok Sabha NDA not only retained most of the provisions of UPA proposed legislation but have also armed themselves with some powers which are beyond subsidy domain.
 
4. That after passing this legislation the government is trying to bring every conceivable institution/public utility under Aadhar registration and everyday advertisement appear that more tahan 100 crore are already registered. Railways are now making mandatory for Senior citizens if they want to claim concession as if other documents are no proof of their age.
 
5.That we discussed the pros and cons of this issue earlier, but surprisingly not after the Act of 2016.  That the matter is still before the Supreme Court for finality.

It is a good news. But the problem is the Govt. is hell bent to keep pushing inspite of the Supreme Court having repeatedly ruled that AADHAR is not mandatory but optional only for the subsidies which are required to be credited directly to the beneficiaries bank Accs.
It is the same party Govt. who vehemently opposed this scheme when brought in by the UPA Govt. and accused the Govt. that through this dubious scheme the Govt. is trying to give subsidy benefits to illegal immigrants from Bangladesh for vote bank and ultimately give them citizenship rights. Now the same party Govt. in total disregard of S.C is making it mandatory for one institution after another. Now the Banks have started insisting for AADHARCard.
The same Govt. now wants to extend to Railways and make it compulsory.
The UPA Govt. had done it without any legislative approval but only under delegated authority in the PMO office.
The objections that there is extensive misuse in Adhar registration, involvement of private agencies and strong possibility of misuse by foreign inteligencies and privacy of an individual are brushed aside.
It appears that this fight which has been going on between the civil society and the Govt. through legal recourse will continue. No country other than India is pushing so hard. Others who tried have given up this Unique Identification . National Identity Card should be the true identity of citizenship. regds

It appears (final reply still awaited) that CBSE has rolled back the clause that Aadhar is mandatory for students appearing in IIT-JEE Main exam after IAC protested and enclosed copy of the SC judgment in in WP(C) 686/2016 titled as ALL BENGAL MINORITY STUDENTS COUNCIL versus UNION OF INDIA dt. 14.09.2016

CPIO of CBSE has today replied in RTI they have notified some clarifications concerning alternative methods to Aadhar for students to sit for the JEE Mains exam. The actual order itself is coming by post.

I feel filing a writ petition in the  High Court may be, perhaps, the best answer. Your case appears very genuine. You may implead Governor RBI and the Union of India (through the Secretary, Ministry of Finance) as the parties. The writ application should be from your wife who should support the averments on affidavit, giving details as to how she came to be in possession of the money. It is a known fact that wives do save money from the household expenses given to them by their husbands, gifts from parents, brothers etc. And they do keep such money in such places as cannot be detected by anyone, including the husband, or be stolen. And at times wives do forget where they kept the money. 

But unfortunately litigation is expensive. It may be a case of the monkey gaining from the fight between two cats - I mean lawyer may gain by way of fee. 

The strongest ground could be "The promise that the RBI Governor has made to pay on demand". Such promise cannot be revoked at the instance of the third Party (Govt).

Another sound ground being that Mr Modi had earlier promised that after 31 Dec 2016 one could deposit the old currency with the RBI till 31 March 2017. 

High Court has the power and in an appropriate case may issue writ.

Dear Col. Srikant

Read this carefully.

By an ordinance the Govt has unilaterally repudiated its sovereign debt contained in the notes you hold thereby releiving the RBI from its obligations to exchange old notes for coin u/s 39 RBI Act.

I clearly recall that I, you, and all similarly placed members of IAC holding old nates, had been regularly visiting the designated RBI offices to EXCHANGE these old notes (u/s 39 RBI Act 1934) but there was a tremendous shortage of coin and low denomination notes or other legal tender and the RBI could not comply with its statutory obligations. (NB: In the absence of coin from the Govt the RBI cannot issue new notes, since new notes can only be issued against replacement or acknowledgment of future Govt debt).

Of course as National Convenor IAC I have been regularly complaining to RBI and Govt about their failures to comply with section 39. The Bombay High Court Judgement in D'Souza's case [link] is unchallenged and binding that even demonetised notes are to be exchanged for value. You can remind RBI that I was protesting on your behalf also since all our emails are with you. I can share the videos of the massive queues we recorded outside RBI's offices till 30th Dec 2016 which prevented most note holders from entering.

Ask RBI ("governor@rbi.org.in") pointedly how they will comply with their section 39 obligations to EXCHANGE old notes at their offices for legal tender considering that they did not hold sufficient legal tender notes on those dates in their issue dept to satisfy you and were ratioining notes at a miserly Rs. 2,000 per person.

Remember Govt can only extenguish the legal tender characteristic of notes, it cannot extinguish RBI's obligations to EXCHANGE notes on demand at RBI's office without an amendment to the RBI Act. The ordinance issued by the President has set aside the law of Parliament since Parliament is not in session (view ordinance here).

My Suggestion

Since you are a senior citizen & an ex-Defence officer,  your reports are likely to be taken as correct as Defence service officers are & have been actually a cult carrying facts as it is, truthfully. 

 Of all existing systems what is amenable is the Third arm of constitution  - Juduciary which have higher degree of reliability. Hence, you may take that route as it is seen practically reliable & dependable, as on date.

So, you can declare the facts supported by possible evidences / witness (if required) under oath in an affidavit in front of  judicial authorities in nearby civil court of law.

Then Take it to the nearest RBI office. Submit it on an application. It is reasonable to expect to get it cleared for payment without further hassle.

[IAC#RG] Scams in Anna Hazare's NGO leads to compulsory audit of 30 Lakh NGOs

The SC PIL by SC Advocate M.L.Sharma exposing the scandals in Anna Hazare's NGO Hind Swaraj Trust which was probed by Justice P.B.Sawant Commission of Inquiry has finally resulted in the SC Bench directing (on 10.Jan.2017) the concerned Govts to ensure audits of Anna 's trusts along with all 30 Lakh NGOs in the country.

India Against Corruption has been regulary cautioning about deceivers like Anna Hazare who act coy and simple in public but whose operstions seem to be functioning on oceans of unaccounted black money in private.

Although Anna Hazare regularly gets all kinds of awards in his personal capacity from unregulated entities for services rendered it is not clear where he accounts for these considering the multiplicity of trusts he is involved in but whose accounts are not up-to-date or filed. His main trust the Bhrastachar Virodhi Jan Andolan Nyas (BVJA) was in serious trouble and most of its trustees have disassociated from him and the Jt. Charity Commissioner Pune had even stopped the trust and was on point of appointing an administrator and had frozen its name. After this happened a desperate and penniless Anna Hazare (who had previously repeatedly stated on national television that he was in no way connected to India Against Corruption) even tried to start using IAC's name after his Biopic flopped badly and he was recently reduced to acting for meat / beef exporters and hawala agents for peanuts.

How low can such people stoop is the question ? Is it the time near that Anna Haazre will again start recommending politicians like Chauthala to the voters against under the table payoffs made to his close associates in Ralegan Siddhi?
