He does not have to show what harm will be caused by disclosing such information as was the case earlier (at least in theory). In any case, until the Government brings the DPDP Act into force, the original formulation of Section 8(1)(j) will continue to hold the field. He does not have to show what harm will be caused by disclosing such information as was the case earlier (at least in theory). In any case, until the Government brings the DPDP Act into force, the original formulation of Section 8(1)(j) will continue to hold the field. This does not augur well for the Independence of the Judiciary which is the common man's last recourse to seek justice. Persons who cannot interpret the law inflict irreversible damage to the justice delivery system.</span><br></p> <p class="MsoNormal" style="line-height:normal;margin:0in 0in 10pt;font-size:11pt;font-family:Calibri,sans-serif"><span style="font-size:12pt;font-family:"Times New Roman",serif">There needs to be total transparency in judicial appointments. The selection process has to be very rigorous and with stringent procedures in place to block the undeserving. This will ensure that only the very best and brightest are elevated as judges. It is imperative that politicians should have no role whatsoever, direct or indirect in the selection of Judges. </span></p> <p class="MsoNormal" style="line-height:normal;margin:0in 0in 10pt;font-size:11pt;font-family:Calibri,sans-serif"><span style="font-size:12pt;font-family:"Times New Roman",serif">Only persons with very sound knowledge of law besides impeccable character and high integrity should be selected. Judges should have the spine to crack on illegalities done by any politician, regardless of the party he is affiliated to and the high position he holds. With the trial at the Sessions Court, the case on various issues traveled to the High Court and Supreme Court several times.</span><br></p> <p class="MsoNormal" style="line-height:normal;margin:0in 0in 10pt;font-size:11pt;font-family:Calibri,sans-serif"><span style="font-size:12pt;font-family:"Times New Roman",serif">It is estimated that the government must have incurred expenses of approximately ten crores on this case which is yet to see its finality. With that money, the Government could have set up a state of the art full fledged Health center at the Old Ribandar Hospital with all the possible facilities to cater to the health needs of all instead of politically and vindictively hounding one individual. It is anguishing that the state exchequer has been drained on account of the witch-hunt waged by the BJP against Tarun Tejpal. Why should the tax-payer have to bear the brunt of such a wasteful politically orchestrated plot?</span></p> <p class="MsoNormal" style="line-height:normal;margin:0in 0in 10pt;font-size:11pt;font-family:Calibri,sans-serif"><span style="font-size:12pt;font-family:"Times New Roman",serif">Will the government enlighten us as to in how many other cases it has Suo Motu initiated criminal proceedings and gone hammer and tongs as done in the Tarun Tejpal case by incurring such a huge mind boggling expenditure? But this mandatory duty has been blatantly flouted by the authorities with most government websites themselves dysfunctional or not updated. What is the use of right to freedom of speech when the people do not have their rightful access to information?</span></p> <p class="yiv6273411425MsoNormal" style="margin:0in 0in 10pt;line-height:115%;font-size:11pt;font-family:Calibri, sans-serif;"><span style="font-size:10pt;line-height:115%;font-family:New serif;">The Judiciary needs to step in to ensure that the Government complies with the mandate of the RTI Act.
