Re: [IAC#RG] Are judges becoming too powerful ?

I dont think judiciary by taking some strong decision is doing any wrong. Today when parliament doesnt run not only bcoz there are many opposition rather govt self doesnt want it to run, discuss budget in detail, pass important bill rather taking the help of ordinance to show it more people friendly.
Yes there are corruption also in judiciary but when they are taking some good step we should appreciate it.
Today before every election we discuss criminalisation of politics and politicisation of criminals. Now its a time to disconnect the word criminal with politics with the help guide of Court and we should support it.
Its a time to clean a hazzy picture a give it a new look. Today when in every road there is atleast an activist we should take a best opportunity of it. The biggest hurdle is the corruption in activist before anything.

Are judges becoming too powerful  ?

In recent times, it appears that the country is being run by judiciary.  There are many occasions when one may  think that the judiciary  is commenting and passing judgements on matters , which should really form part of governance  and  where there is  no issue of law involved.
Even if there are potholes on the road , people take the issue to court and the judges entertain such cases and then make strong observations about the poor  quality of governance.  In the process, reluctantly or otherwise, the  judiciary  is  causing great damage to the reputation of the government and  reducing the esteem of the persons holding high and responsible position such as Prime Minister,  in the eyes of the citizens.
In our country where  the credibility  of ministers, politicians and bureaucrats have become so low, many people tend to support judiciary  without questioning the appropriateness of the role of judiciary in  interfering in the matters of governance , when it makes highly adverse comments.
We seem to be redefining  the role of judiciary in India.  The question is whether all  the judges are always honest  and credible unlike some  politicians and bureaucrats.  The sad fact is that many judges themselves have been accused of dishonest practices and  corruption in recent times.   Is it right  to put so much of faith on the judiciary in such conditions  and is it not a calculated risk ?
Since  citizens  feel  helpless  in the light of  the  inefficiency and corruption of the ministers and government machinery and  are  desperately looking for solution, judiciary  appears to be stepping   into  the vacuum.

Re: [IAC#RG] Are judges becoming too powerful ?

Dear Sir,
You stated Judiciary is stepping into the vacuum and it also is becoming active where no issues of Law are involved.
Are you feeling bad that corrupt/plunderers of nations wealth/ crony capitalists/ dynastic nincompoops/yes men/ sarkari intellectuals/ manipulator s of the simple people/  so called leaders elected by a minority of people ARE being asked to OWN UP to their misdeeds.
People just because they have impressive attributes and capacity to manipulate and sit in high positions cannot be called leaders.
Leaders will be only known by the results they produce for the common good in general and poor/ marginalized in particular.
Further ' Nyaya' and ' Dharma' being inseparable, why 'Nyayadhish' ie the ' Judge' cannot pronounce his judgement on the people in high posts if they are wrong /corrupt/anti national/anti poor and Aamaadmi.
Will it be okay if some entity other than Judiciary ( may be in the guise of Robinhoods )run the affairs of the nation unchallenged, tinker with social order/ norms. Won' t absolute power corrupt them also absolutely.
At least Judiciary being Law can be Expected to be NOT to become a Law unto themselves.
By the way, if a challenge is perceived by you, you also must have some solution , which if not perfect, will at least start a debate.
My solution , The Judiciary shall be empowered to be a Watch dog to monitor FINALLY whether all checks and balances involved in the running of a Nation are effectively working and take a prompt action if a Conscientious Citizen approaches them with a PIL.
The alternate could be to have a Poodle faking Toothless pseudo intellectual pouring over all complaints against Govt and PLEAD with the Powers to be to mend their wayward ways with folded hands ( if not with his tail between his legs)
The views are entirely mine and no reference has been made to IAC.
Regards.

No sir, I dont think so.
If you have the recent pronouncements about election in mind, please think in which democratic countries, almost 1/3 of the MPs have criminal cases pending against them? The argument of the politicians that most of them are politically motivated, is specious. If the fault lies with police investigation, imagine how many innocents from civil society must be languishing in prisons through false and motivated cases of the family, relations and the State.
Election reforms have been overdue and there was so much discussion on this forum.
All political parties pay lip service to the reforms but do precious little through legislation/amendment in election laws.
In which democracy you have scams unearthed year after year as in India Tjere were 21 scams in 2011 and 20 in 2012 as listed inWikipedia and the list goes upto 1948 in decending number.
CIC,s historical decison on Scope of RTI extending to political parties is being negated through ordinance or amendment in the ACT.
Governance abhors vaccum and if the executive and the legislature leave the space, judiciary which is very much a part of governance has to step in.

Re: [IAC#RG] Are judges becoming too powerful ?

Hi Venkatarmanji,

I had just commended Judiciary for their role in stepping up gas on Acid attack victims plight with respect to Acid sale regulation and also Convicted politicians being disqualified from Membership of Parliament & assemblies.

My question is if elected representatives have no botheration about 2G or Coal Gate or Rape cases or even dying people in remote rural districts when our godowns are full? WHO else WILL? Can India afford its million youngsters taking out rallies and dharnas for laying roads, building toilets in Government girls school in cities, laying manhole covers to stop children from dying?............................

Who will care for the common man when elected representative is sleeping. Most cases filed at Supreme Court or High court are by well informed civil society members and i do not suppose courts have taken upon themselves to pass the strictures on Government.

Its a complicated scenario in which we as people are put in, If black money is in reality a issue as discussed widely in IAC forums. What has government done to bring it back, if not for the prodding done by India's courts.

I would suggest the legislature- Indian Parliament make Indian judiciary highly accountable in the sense its Judges and lawyers must be impeccable in their antecedents and also make them amply equipped with resources to discharge their duties. So Now elected representatives are bound by a fair Judiciary even if it means pulling up netas and Babus not doing their roles.

Judiciary becoming powerful for a country like India is a new Chapter in its fledgling Democracy when we have seen larger than life Politicians like Indira Gandhi, Emergency, Wars with Neighbours, etc............................
