dear,
 rapes are not in increase. they were there since the dominance of male folks to show their manhood. it comes in to light since 24x7news channels came in to existence. secondly women organisations have become more active, and thirdly legally it is declared as a crime. 
still the claimants are not getting right of FIR in police stations, neither they are sent immediately to any doctor to have the proof. mostly these cases are tried to hush up! if you go to red light areas you will see many innocent girl children-adolescent girls are forced to do the work. husbands at homes are also many a times culprits, for forcing the act in any physical condition of a lady by perversive way. if you are not aware then let me tell you that real fathers, brothers also do not leave their own blood relations when they get urge. Any woman of whatever age is targeted. 
till now it was done silently. now it is coming in public. we have to change our mentality instead blaming and expecting someone outsider to take action. as a responsible citizen what are you doing, please ask your inner voice.

While  the politicians and the  ministers stand condemned , one person who comes to the mind of everyone immediately is the Prime Minister Mr. Narendra Modi.  What is he doing ? Why is he remaining silent ? Why is he not condemning these incidents in the strongest terms and ask the officials and  police to put down such incidents with all the force at their command. He is the Prime Minister and he has the duty and responsibility to protect the helpless girls and women.

By his silence , millions of people who voted for B JP government only based on expectations and faith  in Mr. Narendra Modi feel  helpless  and frustrated. One hopes Mr. Modi will wake up to his responsibility.

FERDINO REBELLO VERSUS OUTLOOK: A FIERCE LEGAL BATTLE IN THE RECKONING

Anyone planning to file a defamation case would be well advised to seek former Advocate General of Goa Subodh Kantak's opinion and guidance on his first hand turbulent experience with the libel law. 


In 2008 Subodh Kantak initiated defamation proceedings seeking from me 15 crores by way of compensation for the statements made against him.  In his petition Subodh Kantak had complained that the allegations against him were mentally agonizing, inconvenient and caused him a lot of indignation while vowing to use those 15 crores for charitable causes like old age homes, orphanages and towards the welfare of animals.


Few defamation cases land up in the High Court and the Supreme Court. But the Subodh Kantak case did take a long journey from the lower Court to the High Court and later to the Supreme Court. But ironically Subodh Kantak after being repeatedly fined by the Court for being absent, instead of pursuing his case decided to exit possibly realizing that  he was only getting further defamed on account of the documentary evidence with which  he was being confronted  during his  cross examination. Due to that legal battle we now have a 34 page landmark judgment passed by then Justice Nelson Britto of the Bombay High Court at Goa exhaustively outlining the parameters of cross examination in a defamation case.   


Goa is now set to witness another round of interesting and livid defamation proceedings. Former Chief Justice of the Allahabad High Court Ferdino Rebello has moved the Panaji Court seeking 75 crores by way of compensation from the 'Outlook' magazine for the alleged defamatory article published by the magazine on 4th October 2010. Ferdino Rebello in his  75 crore suit filed through his power of attorney Advocate Mario Pinto Almeida has interestingly not invoked the provisions of the Civil Procedure Code but has taken  recourse under  Articles 2361,2362,2363 read with Article 2389 of the Portuguese Civil Code.


Over the years courts around the world have developed case law that seeks to reduce defamation's infringement on freedom of expression. Unlike the defamation law which seeks to limit harmful statements, freedom of expression encourages public discourse. While the debate over the defamation law continues there is a general move to protect a broader spectrum of reasoned criticism. Even where courts have found a person guilty of defamation it has recognized that imposition of sanctions can have a dangerous chilling effect on the freedom of expression. In fact, international courts have developed new ways to protect freedom of expression in defamation cases. In defamation cases truth is a complete defence as the law does not permit a person to recover damages in respect of an injury to a character he does not possess. In a civil action for defamation the claimant needs to prove that the statements injured his reputation. The onus then shifts to the defendant to prove that the imputations or statements were either true or amounted to a fair comment.

 

The feisty jurist Ferdino Rebello versus the mighty Outlook magazine legal battle is poised to be an interesting case for the legal fraternity to watch. The Court proceedings which begin on 5th of August will definitely be marred by objections and counter claims. The first possibly being that it has been filed as Justice Ferdino Rebello though he retired way back on 30th July 2011.

IAC members may recall a campaign we started to shut down 2 highly
pornographic .IN websites about 2 months before the LS elections.

Since the sites were hosted in Mumbai our campaign reached Milind
Deora (MoS for IT) and Priya Dutt when the UPA Govt babus continuously
evaded closing these sites on IAC's complaint. But even these 2 MPs (1
of whom was actually the dealing junior Minister) didn't (or couldn't)
shut down these 2 highly lucrative sites which are allegedly financed
by relatives of a leading politico using havala through Pakistan.
These sites were so shameless that they even had scandalous
"celebrity" pictures of their own Party President in dirty business.

After the BJP Govt came to power IAC complained about 3 additional
porno .IN websites blatantly controlled from a chappie in Pakistan
(openly registered to him in PK). These websites had explicit dirty
"celebrity" pics of a current BJP MP (and former Union Minister)'s
celeb daughter. Despite this for almost 2 months the BJP Govt took no
action on IAC's complaint even though the dealing Union Minister (BJP)
is very close to the MP concerned.

Left with no alternative - and unwilling to pay the bribes demanded,
IAC translated about 20 pornographic pictures with their filthy
captions into Gujarati language and discreetly sent it to "The Man"
last week. 2 of these sites were finally "rendered inactive"
yesterday, the 3rd had stopped down on its own on 22 July.The 2
lucrative .IN porno sites with pics of Congress persons continue to
operate but those photos have been deleted (for now)

MORAL :
(1) There is no practical difference between Congress and BJP.
(2) Even if you have the cleanest persons at the top - the 2nd rung of
Ministers in both parties are as corrupt as before / each other.
(3) During Congress corrupt raaj - I don't recall tomatoes ever being
Rs.100/kg in Safal outlet

I am in full agreement with the points raised by you. Time and again politicians of the country, irrespective of party line, has put aspersions on Muslim citizens of this country. This is very humiliating. Why Sania Mirzas, and Sharukh Khans and the likes have to prove to Tom, Dik and Harry, their patriotism? Hindus have not taken the responsibility of this country. The country belongs as much to the Hindus as to the others. Yes, Narendra Modi have to show to the country that he is doing something against these idiots. The irony of this country is that politicians remain the same in every party.
