[HumJanenge] Good labour lawyer/service lawyer in Mumbai Pune area ? ( apart from Adv Mihir Desai)

Dear all

I am looking for a good labour lawyer in Mumbai-Pune area to fight unfair victimization and abuse at workplace, as a whistleblower. I have tried to fight internally but brotherhood of Babus are stonewalling all attempts.

So only option is to seek judicial intervention.Sorry for using the forum as poster board.Hope I will be forgiven.

A good article indeed but seems anti-congress because as said that the opposition is equally responsible for the same then the author should also make opposition accountable for the cause! Nobody talks about a loby i.e. Anna & party? We should talk for solution and a comfortable/genuine fight for the eradication of congress raj from power! If BJP comes to power than what change may be expected if they are already equally accountable for the cause being in opposition. Why not the whole Anna lobi & experiment AAP for the better prospect of India. We should talke on these topics openly without prejudicely biased!

शुरूआत 2004 से क्यों आकी जा रही है? इस प्रश्न का उत्तर भी आगे के
विश्लेषण में परिलक्षित होता जायेगा।
दो सत्ता केन्द्रों को स्वीकृति देना कांग्रेस पार्टी और सोनिया की सबसे
बड़ी मूर्खता थी। कांग्रेसी नेता सोनिया की इस मजबूरी को समझ चुके थे कि
भारत की नीतियों पर अमेरिका लॉबी का कब्जा हो चुका हैं और मनमोहन सिंह
उसके प्रतिनिधि हैं। यह समझ देश के नौकरशाहों व अनेक केन्द्रीय मंत्रियों
व कांग्रेसी नेताओं के साथ-साथ कारपोरेट लॉबी को होना स्वाभाविक था और
विपक्षी दलों के शीर्ष नेताओं को भी। नीति निर्माण में अमेरिकी हितों का
ध्यान रखने की मनमोहन सिंह की कार्यप्रणाली से कांग्रेस व नौकरशाही व
कारपोरेट लॉबी का एक वर्ग मनमोहन सिंह के इर्द-गिर्द लामबंद (चंडीगढ़
क्लब) होता चला गया। यूपीए-एक में चूंकि कांग्रेस के पास कम सीटें थी और
अमेरिकी समर्थक नीतियों के दुष्परिणाम सामने नहीं आये थे, इस कारण 2009
के आम चुनावों में वामपंथियों के समर्थन वापस लेने के बाद भी बिखरे
विपक्ष के कारण यूपीए की वापसी हो गयी। किन्तु इस चुनावों तक कांग्रेसी
कार्यकर्ताओं की हाईकमान से दूरी बननी शुरू हो गयी थी और पार्टी
अवसरवाादियों, तथाकथित वामपंथी बुद्धिजीवियों व पूँजीपतियों की गिरफ्त
में आती गयी। 2009 के आम चुनावों पैसों के बल पर, खैरात बाँट कर,
विपक्षियों को भ्रमित कर तथा वोटिंग मशीनों में गड़बड़ी करके जीते गये थे
और कांग्रेस के खाते में लाख कोशिशों के बाद भी 11.5 करोड़ वोट व 208
सीटें ही आ पायी थी।ं
सन् 2009 की जीत ने सोनिया को साहसिक बना दिया और वे मनमोहन से इस्तीफा
माँग बैठीं। वे या तो स्वयं प्रधानमंत्री बनना चाहती थीं या राहुल को इस
पद पर बैठाना चाहती थीं। लेकिन अमेरिका के इशारे पर मनमोहन ने इस्तीफे से
इंकार कर दिया और राजनीति के पिछले तीन वर्ष सोनिया मनमोहन के बीच
'शीतयुद्ध' के गवाह हैं।
कांग्रेस पार्टी के पतन में सबसे बड़ी कारक स्वयं सोनिया ही है। उनका
विदेशी मूल का होना और ठीक से हिंदी नहीं बोल पाना, उन्हें कार्यकर्ताओं
से दूर कर देता है। वहीं राष्ट्रीय मुद्दों पर उनकी चुप्पी भी सभी को
अखरती है। दस जनपथ में उनकी कार्यशैली मुगल शासकों की याद दिलाती है जहाँ
व्यापारिक मानसिकता से राजकाज का संचालन किया जाता है। सोनिया का विभिन्न
पदों पर नियुक्तियों करने, ठेके दिलाने व परियोजनाओं को मंजूरी दिलाने की
संस्तुति देने का काम 'बोली लगाÓ काम उठाने जैसा है। वफादारों को अयोग्य
होते हुए भी उपकृत करना, यूरोपीय लॉबी को अधिकतम काम दिलाना और विभिन्न
मंत्रालयों व कांग्रेस शासित राज्यों में भी अपने 'विकास माफियाÓ का
नियंत्रण रखना शामिल है। कांग्रेस पार्टी में एक-एक कर जननेताओं का
हाशिये पर चले जाना भी सोनिया की सोची समझी राजनीति व भय का परिणाम है।
कांग्रेस शासित राज्यों के मुख्यमंत्री जनता से न जुड़े होकर 10 जनपथ से
अधिक जुड़े होते है और ऐसे में स्थानीय हितों की अनदेखी तो होती ही है,
व्यापक भ्रष्टाचार व अपसंस्कृति भी फैलती है। इससे कांग्रस पार्टी से
आमजन दूर होता गया।
सत्ता में बने रहने के लिए सोनिया गाँधी वोट बैंक की राजनीति खेलती रही
हैं। अल्पसंख्यकों, दलितों व जनजातियों को वोट बैंक के रूप में प्रयोग
कांग्रेस पार्टी की प्रिय शैली रही है। कमजोर वैचारिक धरातल की यह
राजनीति चमत्कार, मीडिया हाइप, आरक्षण, अनुदान, छात्रवृत्तियों, पेंशन,
विशेषधिकार आदि आदि देकर की जाती है। उच्च जातियों के शोषण की कहानियों
को बढ़ा-चढ़ाकर बताया जाती है और भ्रमित व उत्तेजित करने वाला साहित्य इन
वर्गों में बांटा जाता है। यह राजनीति वामपंथी व पेड बुद्धिजीवी, पेड
मीडिया, बहुराष्ट्रीय कम्पनियों व पेशेवर नेताओं (वफादार) के माध्यम से
खेला जाता है। निष्पक्ष काम करते दिख रहे एनजीओ, बुद्धिजीवी, विभिन्न
संगठन, चर्च, अल्पसंख्यकों की संस्थाएं, फिल्म निर्माता-निर्देशकों,
कलाकारों, लेखकों, रंगकर्मी आदि की एक पूरी शृंखला कांग्रेस पार्टी ने
खड़ी कर रखी है जो एक सुर में हाईकमान के इशारे पर गलत को सही व सही को
गलत साबित करते रहते हैं।
जिस प्रकार सोनिया व मनमोहन तथा कांग्रेस पार्टी व सरकार दो ध्रुवों में
बंटी हुई है किन्तु एक संतुलन बनाये रखने की कोशिश रहती है, ऐसा ही कुछ
नीतिगत स्तर पर है। वर्तमान में पूँजीवाद व बाजार की अंधी दौड़ को शुरू
करने वाली यह पार्टी कारपोरेट के हितों के अनुरूप व अमेरिका, रूस, अरब
देश, चीन व यूरोपियन यूनियन के फायदे की नीतियां बनाने में आतुर रहती है।
स्वाभाविक रूप से यह विशुद्ध व्यापार है जिसमें कांग्रेस पार्टी के लोग
अपने व्यावसायिक हित सर्वोपरि रखते हैं और यही हित कांग्रेस पार्टी के
पतन का कारण हैं।
फोच्र्यून 500 कम्पनियों को खेल में अब भारत फंस चुका है। सोनिया-मनमोहन
दोनों गुट इन कम्पनियों के फायदे के लिए जो भी नीतिगत फैसला करते है,
उससे भारतीयों के परम्परागत व्यापार, उद्योगों व कृषि पर नकारात्मक असर
पड़ता ही है। लोगों की नौकारियां छिनना, जमीन हड़पना, बेरोजगार होना और
महँगाई का शिकार होना अब भारतीयों की जिंदगी का हिस्सा बन चुका है।
स्थिति इतनी बुरी है कि सरकार को 67 करोड़ लोगों को खाद्य सुरक्षा देने
की घोषणा करनी पड़ी है। यानी लूट का कुचक्र देश की दो तिहाई जनता को
गरीबी की रेखा के नीचे धकेल चुका है। एक बेहतर जिंदगी जी रहा या जीने की
आस में जी रहा यह वर्ग निश्चित रूप से सरकार व कांग्रेस पार्टी से नाराज
है और खाद्य, स्वास्थ्य, मजदूरी, शिक्षा आदि के अधिकारों की जगह रोजगार
मांग रहा है जो कांग्रेस पार्टी दे नहीं सकती। इस कारण जातीय व
सांप्रदायिक हिंसा, नक्सलवाद, क्षेत्रवाद व भाषायी झगड़ों की राजनीति को
जानबूझकर योजनाबद्ध तरीके से बढ़ाया जा रहा है। किन्तु आम जनता में
जानकारी व समझ विकसित होने से कांग्रेस पार्टीं के प्रति नाराजगी व
आक्रोश बढ़ता जा रहा है
कांग्रेस पार्टी के कारपोरेटवाद व बाजार बाद का सबसे बड़ा शिकारी मध्यम
वर्ग व उच्च वर्ग है। यह रोज खर्च करता है और खूब खर्च करता है। इसको
लूटने के लिए क्रिकेट, पोर्न, क्लब, नशा, फिल्में व मनोरंजन के चैनल,
कम्यूटर, इंटनेट, मोबाईल,फोन, गैजेटस के साथ पाश्चात्य जीवन शैली को
परोसा गया जो मस्ती व लापरवाह जिंदगी की ओर ले जाती है। एक षड्यंत्र के
तहत विदेशी सामान, उपभोक्तावाद, चमचमाते अस्पताल और महंगी बीमारियां,
चमचमाते निजी शिक्षा संस्थान (अंदर से खोखली कबाड़ फैक्टरी), मॉल कल्चर
नयी पीढ़ी को परोसी गयी। धीरे-धीरे लालच की हद बढ़ गयी और सभी उपभोक्ता
सामनों के दाम बढ़ते गये हैं और मध्यम व उच्च वर्ग की आमदनी व बचत उनकी
जेब से निकल बड़ी कम्पनियों के खातों में चली गयी है। अब कर्ज, ईएमआई,
तनाव, क्रेडिट कार्ड, बेरोजगारी, दिशाहीनता, जड़ो से कटाव, अनुपयोगी
शिक्षा लिये यह वर्ग चौराट्टे पर खड़ा है, और एक प्रतिशत उच्चतम वर्ग इस
लूट को विदेशों में पहुंचा चुका है। देश में महंगाई, मंदी, मुद्रा स्फीति
व बेरोजगारी सभी बढ़ रहे हैं। घोटालों के द्वारा लूट, शेयर सट्टे द्वारा
लूट, महंगाई द्वारा लूट, उपभोक्तावाद द्वारा लूट का जो कुचक्र कांग्रेस
पार्टी ने खड़ा किया है, वह इसके लिए भस्मासुर बन गया है।
कांग्रेस पार्टी का संगठन व नेतृत्व भी कमाल के हैं। संगठन है ही नहीं व
70 प्रतिशत से अधिक नेता दूसरे दलों से यहाँ आये हुए हैं। अगर सच कहें तो
मनसबदारी प्रथा के समान ठेके उठा दिये गये हैं, वफादारी मापदण्ड है और
लूट का हिस्सा देते रहना पद पर बने रहने की गारंटी। यह जनता के हितों को
संरक्षित करने वाली पार्टी रही ही नहीं, यह अल्पसंख्यकों व अवसरवाादियों
का गठजोड़ है जो सिर्फ और सिर्फ शासन करने व लूटतंत्र का राज बनाये रखने
को आतुर है और किसी भी संवैधानिक संस्था की बाट लगा देता है, किसी की भी
गरिमा भंग कर सकता है और किसी भी स्तर तक जा सकता है। 'ठेका पद्धतिÓ की
यह शैली अब बहुसंख्यक समुदाय को समझ आ गयी है और वह 'बांटो व राज करोÓ के
षड्यंत्र को समझ चुका है और वह अब एकजुट हो रहा है, ऐसे में कांग्रेस का
पतन तय हैं। कहा जाता है कि जब प्रमुख कांग्रेसी नेता व यूपीए के सहयोगी
दलों के नेता अपने पोर्टफोलियो में बदलाव करते हैं तब दुनिया के शेयर
बाजारों में खासी हलचल मच जाती है। डॉलर-पौंड-रूबल-यूरो-दिनार की विनिमय
दरों के उतार-चढ़ाव भी इन नेताओं की ही देन हैं। अब इस खेल को पूरा देश
समझ चुका है अत: इनसे निजात चाहता है और यही कांग्रेस के पतन का कारण बन
गया है।
कांग्रेस के काले कारनामों में भागीदार सभी देश व उनका पोषित मीडिया भारत
में उपभोक्तावाद, मानवाधिकार नारीवाद, सुशासन, पारदर्शिता, कानून के शासन
व लोकतंत्र के विकास संबंधी आंदोलनों को वित्तीय सहायता देते रहे है। यह
एक और छलावा होता है, जो इनके कुकर्मों को ढांपने के काम आता है। जनता
समझ चुकी है कि विभिन्न नक्सली गुटों, चर्च, मदरसों, पिछड़ी, दलित व
जनजातीय, भाषाई व क्षेत्रीय अंदोलनों को भी यही देश संरक्षण व धन देते है
तो आतंकवादियों को भी। इस दूहरे खेल का शिकार अब जनता नहीं बनना चाहती और
न ही अपने देश को प्रयोगों का मैदान बनाना चाहती है अत: कांग्रेस का पतन
तय है। जनता समझ चुकी है कि सोनिया प्रभावहीन है, मनमोहन कठपुतली है और
राहुल अपरिपक्व है और शेष कांग्रेसी पुराने कांग्रेसियों के बच्चे हैं,
इनमें जन नेता कोई नहीं है, भारत की बात करने वाला भी कोई नहीं। यह
मुगल-ब्रिटिश शासन की अंतिम कड़ी आधे मुगल और आधे अंग्रेज है जिनसे निजात
पाना जरूरी है। इसके बाद जो कोई भी विकल्प आयेगा वह इसके बेहतर व भारतीय
होगा बस इनसे मुक्ति मिले।

सम्मान देती तथा जनभावनाओं की कदर करती।
3. परिवार वाद से मुक्त हो पाती।
4. बांटो और राज करो के स्थान पर देश की आत्मा व सांस्कृतिक स्वरूप को
समझती और पहचानती तथा देश कोर समग्र विकास का नक्शा बनाती।
5. पार्टी में आंतरिक लोकतंत्र की स्थापना करती।

Although I am not a blind supporter of any political party, after seeing this post, one thing comes to mind.

The Supreme Court is asking for foreign funding of the AAP. The other political parties are also raising questions.

But one thing is clear, that AAP has atleast a known source of all its funding where as most other political parties do not have the known source of funding. It could be even ISI

So why not ban all the political parties in the country who cannot tell you the source of even a single rupee in their fund??

Even if a foreign Citizen comes to India converts his dollars into Indian rupees and donates to a political party it will still qualify as a donation from a forign source.Likewise if an Indian Citizen while on a visit abroad remits a donation from outside India it will not qualify as one from a foreign source .That is why the isisue is beyond any doubt whatsoever.

In short, the term "include" is used to ENLARGE the language of the statute, and it usage is ordinarily not construed/restricted as "means" (as you have used it).

Nonetheless, the language of the statute under examination is perfectly clear on "foreign sources", even if we take the ordinary or dictionary meanings of the 2 terms.

"Foreign" means "from outside". If currency comes from outside India it is "foreign". This aspect was also clearly debated at time of amending the Rep. of Peoples Act in 2010.

Today when an NRI cannot vote from outside India, the question of his donating money from outside for political activity is excluded equally. We saw very well what happened during the Khalistani, Naga, Tamil etc. separatist movements which were foreign funded by NRIs to wage war against the Indian State. As patriots we cannot permit this and neither should we defend such dangerous propositions.
