Re: [IAC#RG] FYI: LG finally forwards IAC's 900 cr. UIDAI land scam complaint to DDA

All decisions have to be in larger public interest, meaning thereby that under the circumstances, with due diligence,no other better decision could have been taken,or was possible. For that a decision tree and decision matrix needs to be formed. Its a serious professional exercise and not a "feudal" one. For decades together  adhocist decisions have been taken and passed on as those taken "in public interest".
That was because of secrecy and lack of awareness on part of the civil society.
No more of it should be possible with enlightened citizenry getting hold of all malfeasance. Thats the importance of such excellent fora and activist persona.

It has also emerged that there is a major potential scandal involving the role of a Joint Secretary in the Ministry of Urban Development, and it is very likely that there shall be a full blown CBI and CAG enquiry into such land-grab scandals as the UIDAI's is only the tip of the iceberg, and at least 90 other large prime plots land use has been misclassified and/or changed causing loss of over Rs. 18,000 crores to DDA in the course of past 2 years.

LG finally forwards IAC's 900 cr. UIDAI land scam complaint to DDA

Murali Krishnan | India News Political Bureau, Delhi, Thursay August 01, 2013, 23:12 pm (IST)

The Lieut Governor of Delhi (LG) has finally forwarded today to the DDA the IAC National Convenor Sarbajit Roy's complaint of massive corruption in acquiring prime land by the UIDAI (Unique ID Authority of India) at throwaway prices due to the site's irregular use status. All the senior officers of the DDA, including DDA's Vigilance Director, had returned or refused to accept IAC's vigilance related complaint. The Delhi Development Authority is an autonomous statutory self financing authority set up under an Act of Parliament in 1956, but over the years has been converted into an extension of the LG's residence through a series of confidential letters issued by the Central Government under the said Act.

The text of India Against Corruption's complaint alleging the UIDAI has been transferred prime public land in Central Delhi at throw-away rates in conjunction with Delhi's land mafia is reproduced below.

Respected Sir

Kindly find below my objections and/or suggestions to the subject public notice for statutory consideration under sub-section 11-A(3) and otherwise

OBJECTIONS:

1) There is no reference to the specific site / land use of the modification in the present Master Plan, ie the so-called MPD-2021, or at least I am unable to find it in the MPD-2021 land-use plan available on the UDM website.

2) The public notice speaks of modifying the Zonal Development Plan for Zone-D. I say there is no such plan in existence. To the best of my knowledge the ZDP-2021 for Zone-D is not in existence. The last I heard was that a known incompetent private planner, some Mr. Ribiero or suchlike, had drafted up such a ZDP for the NDMC and DUAC to suit the the land mafia, but it was so patently atrocious and self serving that it is yet to see the light of day. So please show me the referred ZDP-2021 for Zone-D as I am yet to see it. It is pertinent that I am a long time resident of Zone D which, unlike every other planning zone, has no ZDP and I fail to see why I am being discriminated against in planning issues.

3) I object that the lack of an up-do-date ZDP for Zone-D is allowing some organisations to swallow land notified for public and semi-public use and convert them into govt offices by misuse of section 11A. The most blatant such example being APPU GHAR which was swallowed by Supreme Court and DMRC, and in which all the public objections opposing the CLU were CORRUPTLY ignored by DDA. The SC used the land to sell to its advocates to set up private law chambers and the DMRC put up a tall commercial building to house some Railway Freight Corporation.

4) I object that there is no such "authority" known as UIDAI. The law to set it up is yet to be passed by Parliament, and the UIDAI is functioning, illegally, on the basis of an EGOM resolution whereby a private industrialist Shri Nandan Nilekani of INFOSYS was secretly appointed its Chairman without following due process and given the status of a Union Minister. I have established this under RTI, as I was the person who brought UIDAI within ambit of RTI as an extension of the Planning Commission. It is pertinent that when the Planning Commission received a copy of the CIC order in my case, they immediately asked Mr. Nilenkani and his team to vacate their offices within Planning Commission building within 48 hours. UIDAI then had to hire offices in Jeevan Bharati Building virtually overnight. The JPC (Joint Parliamentary Committee) has also objected to the UIDAI and said it is a useless body which should be scrapped.

5) It is thus clear that after I exposed UIDAI as being a fraudy outfit, they have managed to CORRUPTLY acquire a vacant plot of land in 2010-11 which is the subject of this CLU. It needs a CBI / CAG investigation as to who all in the Ministry of Urban Development or it's offices like L&DO / DDA etc. transferred the land which was Public/Semi-Public use in nature. It needs to be seen if the plot was acquired on commercial rates or it was a concessional allocation. The entire land acquisition / transfer file should be provide to objectors. There must be a CBI/CAG/ACB investigation into the modus operandi that the plot is acquired at a cheap rate and then the land mafia upgrades it to commercial use (UIDAI is a semi-PRIVATE concern) by bribing MoUD officers and ministers of UPA govt. It is pertinent that INFOSYS has aquired a 1,000 sq yard plot in Vasant Vihar (Zone-F) last year for about Rs. 105 crores, so the land rate for a prime plot in Zone D should not be less than Rs. 20 lakhs per sq yard or about Rs. 900 crores for a 4,40 sq yard plot.

6) This CLU change will have significant alterations in local / site population density. Hence the CLU must be considered by the Central Government u/s 11A(2) only. The DDA has no role to play other than issuing the statutory notice. Members of the Authority have no role to play either, and their participation in any Board of Enquiry and Hearing is a breach of statutory provision which shall be reported to the CBI and the ACB.

7) The UIDAI already has a massive Headquarter at Bangalore / Karnataka. I seem to recall that the ZDP/ MP2021  and the NCR plans not only mandates that no new Government offices are to come up in Delhi, but also that the existing ones are to shift out of Delhi. Therefore what kind of precedent is being set by such CORRUPT CLU public notices

8) Please take clear notice that the citizens could not object when the DDA approved numerous spot CLUs to oblige the Delhi High Court and the Supreme Court of India to grab land all over Delhi to accommodate their advocate's chambers only because their judges are a law unto to themselves under the Judges Inquiry Act and the SC judgments. However, for such corrupt CLUs like the instant one, DDA officers shall and will be reported to the CBI/CAG/ACB if they persist in rolling over to approve perverse CLUs to grossly favour semi-private irregular operators like UIDAI who are being facilitated to grab PUBLIC land at throwaway prices.

9) Not only is UIDAI so confident that their CLU will be approved, they have already conducted a design competition for their building - the winning bid for which seems to have a hugely tall structure well over the 15 meter height limit. It is thus clear that UIDAI / land mafia have advance information about  impending Master Plan changes to allow this. This is also definitely a matter which falls for the CBI etc. to investigate considering that the sub-zone (which may be D4 or D5) is a low profile zone with many heritage structures. [http://www.architizer.com/en_us/projects/view/uidai-headquarters-at-delhi/40953/#.UdE7qpxR7Dw]

10) Accordingly, I SUGGEST that this CLU be scrapped and/or returned to the MoUD.

yours faithfully

Dear Veterans and educated Indians,
I would rather not answer unfounded arguments about privileges extended to the Armed Forces. They are generally illogical and a waste of time for a reply.

Dear Mr Malik,
You are logical in your arguments.
Conditions of Service and certain assurances in the form of acknowledgments for service rendered are prevalent in each of our service be it Armed Forces or Civil services.
One could first begin with the "pension" which should be stopped the moment a Govt servant (applicable to Armed Forces & civil services) becomes a foreign citizen. As a corollary the "ack" or privileges peculiar to each service should also cease.
Leading by example it should start with the IAS the most privileged and molly coddled service and then trickle down to the other services.
I would also like to add here that if any Govt servant is drawing a pension from any source other than The GOI, it should cease forthwith. Be assured the IAS will never permit that to happen. A tenure of 3 years plus in the UN pushing files gets you a pension of $ 1000 tax free. At the present rate Rs 62000/- (tax free). One of our Commissioner (no names) did not push a single file for 2 years rendering my city to garbage , ensured a UN posting for disservice to my city and is drawing double pension. The IAS and UN. During morning walks I always salute him.
I am an Armed Forces veteran and am in full agreement with your observation about foreign Nationals. Please make it applicable to all Govt servants and also those receiving pension from foreign sources.
With Regards

Dear Mr Veeresh Malik,
There seems to be a compulsion to question benefits given to Warriors and their families ( serving and ESM). At the same time
there is a mention of close kin including own mother being recipient of Armed Forces '  benefits/ privileges   Viz.,
Liquor/ reservation for wards of uniformed personnel in education institutions/ pension/ CSD etc.
If pension is a deferred wage , where is the question of reneging by a civilzed nation to keep the promise UNLESS the person has forfeited the privilege by some misdemeanor and actions against national interests.
Further Warriorship being a Rajas ( ref Tamas, Satvik and Rajo Gunas or Traits) most warriors are wont to take food and items like liquor of Rajas type. Exceptions will always be there where some Warriors are teetotallers and vegetarians . Why sermonise or insist one' s Way of life on an unsuspecting section of society under the garb of protecting tax payers money. It is customary not to grudge the specific privileges extended by a civilized community to specific sections of its society ( MPs, MLAs, Rly men, Men of Telephones , Airlines and so on) .There is no need to rave/ rant at the special privileges .
Further ,it is as improper as questioning the privileged seat or treatment given to elders in the family . The one who questions is prone to suffer ( Like Sisupal in Rajasuya Yagna in Mahabharata when he condemns the participants decision to honor Sri Krsna as lunatic behavior of elders owing to their age related mental atrophy).
May good sense prevail and this running down of Warriors cease forthwith. Incidentally Warriors are also tax payers.

Dear Ashok Coomar,

Thank you for writing in, and I must salute your tone of language, far different from the tone used by Shri Pannu.

Now, on contents and some facts:-

1) My mother takes a pension from the Indian Army thanks to my late father, my late maternal grandmother took an award for all 4 sons in the Armed Forces (though only 3 continued, the first had to take a civil job to bring up the zero restart family after '47)

2) I have a list as long as your arm of family members from the close circle of relatives as well as close friends who have been in the Armed Forces and are in the Armed Forces and some have also made the Supreme Sacrifice and so get slightly outraged when people choose to question my patriotism.

3) Not having been in the Armed Forces myself but from an institution which produced the earliest Chiefs of Staff of the Indian Navt as well as other Star Officers for the Indian Army, so connections of not just the Indian Navy, my own training went through the full drill on Armed Forces pattern, and more, including swearing loyalty to flag and country.

My single point question here to you is this - if after retiring, a person from the Indian Armed Forces or Civilian Government services voluntarily exits from Indian citizenship and swears loyalty as well as fealty to another country, then what right does he have to the benefits of the Army Act or similar, whether ex Armed Forces or Civilian?

Would we justify the benefits if, hypothetical situation, the Supreme Commander in Chief, the President of India did something like this?

Please do not try to churn the issue up into other unrelated issues of loyalty, patriotism, and need of the Nation and the hour. I am not a fool to not know the importance of a strong Armed Forces. If it is your contention that strong Armed Forces can not exist without booze, then I have nothing more to say. However, if that was not your contention, then:-

4) As far as duty free booze is concerned, tots of rum could have been justified in gunpowder days, which is what we also were taught, but in this day and age, when Armed Forces personnel are expected to be tech savvy as well as in charge of equipment costing billions? On an ordinary cargo tanker carrying crude oil, a clear window of no booze for 15 days prior is now SOP. A railway engine driver, merchant navy sailor, civil aircraft pilot, truck operator, lab technician, surgeon, teacher, everybody else is supposed to be cold sober nil alcohol. But our Armed Forces expect to get cheap booze?

5) Given half a chance, the dispensation towards no booze needs to be instilled into people joining the Armed Forces from the date of induction, just as it is done in other professions requiring some amount of responsibility. Maybe it is a good idea to put this in the curriculum of the training establishments for the Armed Forces, as is done with responsible Armed Forces, increasingly, worldwide?

Deflecting any rational arguments into vague retorts about being anti-National would make anybody else an easy target, but not me, Coomar, or Pannu - I got far too many family members and friends who have died in the Service of the Nation for you and your ilk to get patronising, condescending and supercilious with me. In addition, I have pursued one too many compensation claim for families of such people where people in service have put obstacles, to not know the truth.

Have a nice day, try and remain sober, and set a good example to the youngsters joining the forces. Calling me names just makes me more keen to do a follow-up article.

Warm regards/Veeresh Malik

It is indeed unfortunate that we have such ignorant citizens in this country who will neither see nor listen to reason. They continue their lament without pausing to analyse whether one should excise the head because of a headache.
There is no alternative to an army to defend the nation. You may be right that there are aberrations but the nation has no option but to take the delinquents to ask rather than spite the entire armed forces as you seem to suggest.
In national interest it is imperative that our countrymen are careful not to run down the entire institution of the armed forces lest it may compels them to follow the lead given by others - forget about the responsibility you are charged with, just line your nest!

Dear Air Commodre (Retd) T Pannu and others in this list.

Ignoring the silly language used by Air Comm Pannu on calling me a "traitor", for which I could easily choose to file a case under the IT Act if I wanted to, which said language does no justice to the rank he claims to hold, let me place a few simple facts on record:-

1) The Army Act and its specific requirement of "citizen of India" (exception - Nepali) is paramount. It supercedes any GOI letter. Aliens, foreigners (which is what people voluntarily become when they renounce Indian citizenship to pledge loyalty and fealty to another country) are not covered under the said Act and its applications to other Services. A similar situation exists with civilian pensioners too. Please wait for the announcement on pensions wrt aliens/foreigners, which to some extent is already in place in practice for ECHS/MI Room benefits. Rank or otherwise, what right do foreigners and aliens even if they were in the Indian Armed Forces at one time, have to enter restricted areas which includes Armed Forces Hospitals, Installations, Offices, Air Force St

BHOPAL: He was the undisputed and absolute authority in Madhya Pradesh leading the erstwhile Congress government ten years ago. And yet on Wednesday evening, the Congress closed its doors on AICC general secretary and former chief minister Digvijaya Singh denying him entry into a press conference.

For nearly 20 minutes, Digvijaya Singh and his supporters stood outside the doors of the state PCC conference hall banging on the wooden panels and requesting entry even as Union minister of state Jyotiraditya Scindia was talking to the media. Scindia has been appointed the party's state election campaign committee chairman earlier this week while Digvijaya Singh has been left-out of the 22-member election committee panel.

Scindia continued to address the media flanked by AICC general secretary in charge of state party affairs Mohan Prakash, senior leader Sanjay Nirupam, PCC president Kantilal Bhuria and leader of opposition Ajay Singh, while Digvijaya Singh's men made desperate calls from their mobile phones asking Congress workers inside to open the door and make way for his access.

As Digvijaya Singh kept waiting outside, Scindia was talking the press claiming there was no factional rivalry within the party. He claimed leaders like Digvijaya Singh, Union minister Kamal Nath other leaders like Suresh Pachauri and the state top-brass were all strung together in a single garland of unity. Meanwhile the banging on the door continued and Scindia asked Congress workers not to let in whoever was knocking. Senior Congress leader Sanjay Nirupam also instructed that admittance into the hall is not permitted.

Congress workers were seen guarding the door from inside lest the Singh and his supporters managed to unlock the gate. When the doors were not opened, Digvijaya Singh walked around the Congress office compound to gain entry through a back door. But that door was also jammed and a miffed Digvijaya Singh turned to the elevator so he could wait for the rest of the party leaders to join him for an election meeting.

But half-way up the second floor, the elevator stopped working. An infuriated and irate Digvijaya Singh had had enough and told his supporters to turn around and walk-out of the state Congress office. Hurt and humiliated, he climbed into his SUV and left the Congress office with his supporters following in a cavalcade.

Recently with approaching assembly elections, Digvijaya Singh is getting unfair treatment at the hands of party men and specially a much younger Jyotiraditya Scindia who is being portrayed as the Congress' chief minister probable. Earlier this month, the Scindia faction organized a rally in Morena where Digvijaya Singh was kept waiting for more than two hours by the Union minister of
state. A much-harassed Digvijaya sat on the dais in Morena sweating profusely and waiting for Scindia's arrival on the stage. The programme scheduled to start at 1pm finally saw Jyotiraditya Scindia arrive at 3:15pm.

But this Divijay had his hand in the division of AP which infuriated the seemandhra people.
