[IAC] Wilful non-compliance of the orders of the Central Information Commission

Subject: Your letter DPS/JD/RTI-09(168)/2013/555 dated 19.04.2013

 

          By your letter above mentioned you have again requested me to visit the Directorate at Mumbai with prior appointment for inspection of the records despite my previous objection to this.

 

          Please note that your offer to merely provide me inspection of a few records at Mumbai, which records also you are not prepared to list out for me in advance, does not meet my requirements, since the form of information access I have requested the information to be provided to me is in the form of authenticated / true copy(s) of such records as have been very well specified by me and are very well known to you.

 

          Please refer my previous letter whereupon I had specifically called upon you to confirm if it was your case that the information I had requested was voluminous in nature and would disproportionately divert your dept's resources. I had also requested you to provide me a list of documents which would be provided to me along with the number of pages which I would be given inspection of (which is the primary duty of the PIO).


          I observe that you have neither been able to confirm that the information is voluminous etc., nor have you provided me the list of information which you hold and shall disclose to me.

          Accordingly, I am caused to believe that you are in league with certain anti-national mafias (controlled from Pakistan) who are looting your department with impunity, so as to lure me to Mumbai under the pretext of providing me information there.

 
          I therefore call upon you to immediately provide me (within 14 days of my letter) by Registered Post the duly authenticated photo-copies of all the files (complete in all respects) which the Honourable CIC had directed is to be given to me vide order dt 08.03.2013 in F.No. CIC/SM/A/2012/001398.


          You may particularly take note that you are in wilful breach/disobedience of a clear direction issued by a public servant acting under his lawful powers directing you to provide me the said information within 10 working days, after all your frivolous objections and denials were dismissed in appeal, and which has attained FINALITY.


          Also take notice that I believe that anti-national officers like yourself, acting as puppets of the nation's enemies, ought also to be reported to the National Investigation Agency (or other specialist bodies) and I shall do so if you persist with your corrupt and mis-conductive ways and don't provide me the information in hardcopy and forthwith as was directed.


          Due to the threat perception from you and your conspirators, I am circulating this email widely throughout the nation to anti-corruption activists, and with copies to all the Senior Govt functionaries, including your Dept's Minister and the Secretary over the "NICNET" so that the true state of affairs inside the Dept of Atomic Energy is known.

a lot of discussion is going on defining the Hindu.
 
well I think the subject matter has been dealt in great detail by our courts and also laws specially so Hindu Personal Laws.
 
Hindu is not a homogeneous social or racial group. It is also not a religion. It is the word which was given by Arabs like many other words like JATS by ARABS and RAJPUTS by British.
 
So let us not try to create something new. the beauty and strength of Hinduism is that it provides you certain key freedoms and those are:
 
1. Freedom of practising your faith? To the extent of even not believing in GOD.
 
2. Freedom to have your own sub identity.
 
3. Freedom to use your own logic or reasoning to question what you wish too.
 
I feel that Shankracharya provided a right base to bring a right balance which in fact assimilated the Jains and Budhist faiths in one platform. So let us not disturb that.
 
what we shall focus are?
 
1. Abolition of caste system. It is a shame.
 
2. Prevent the attempt of temple owners (more than 90% temples in the country are owned by a rich class of people who are now trying to become spokesperson of Hindus. This is the lobby which also owns Congress and BJP both.. This lobby has been controlling political power in the country since independence. This lobby is also opposing Modi) to monopolise it as a religion. The day you try it rigoursly, it will break.

Where is the "corruption" element in not having a Uniform Civil Code ?

1) the Const of India has listed UCC in the Directive Principles of State Policy (saying it is highly desirable but cannot be enforced). The courts have also said the same repeatedly.

2) It is only due to the tolerance of Mughal emperors like Jahangir (whose mother was originally a Hindu) that Hindus were allowed to have their own civil law during Muslim rule - or have you forgotten that ? The British carried on with that policy by adding Christians to the list of persons allowed their own personal law.

3) IAC's position is very clear since 1924.  If Muslims want 4 wives for their males (this is a gross over-simplification) then let them have it   How does it affect you ? Similarly nobody is forcing you to eat Kutha meat nor can you force a Muslim through law to eat Jhatka. In fact if having 4 wives is so very good for Muslims then more Hindu males will start demanding it for their own community. Let there be hearty and organic union (marriages) between Hindus and Muslims when all the good things of each community are exchanged between them.

It is my opinion that all rules must be neutral-gender, religion, community, region etc wise. The specifics in any case will have to be considered by courts which should have judges of impeccable integrity, competent, transparent in their dealings and accountable.

Dear All,

When the High Court has confirmed the legal irregularity, principle of justice demand that the ones who committed the said irregularity be suitably punished.

That should work as deterrent to repeat such irregularities.

I wonder as to why the Culprits who enacted this Law in Bihar have not been punished by the High Court.

माननीय पटना उच्च न्यायालय ने केस संख्या CWJC 17616/2012 (शिव प्रकाश राय बनाम बिहार राज्य) के मामले में बिहार सूचना का अधिकार नियमावली की धारा 6 (2) को अवैधानिक मानते हुए, प्रधान सचिव सामान्य प्रशासन विभाग (बिहार सरकार) को नियमावली में सूचना का अधिकार क़ानून के धारा 19 (3) को ध्यान में रखते हुए तीन सप्ताह के अन्दर संशोधन करने का आदेश दिया है. इससे लगभग तीस हजार सूचना आवेदकों को राहत मिल सकती है, जिनका सूचना आयोग में दायर द्वितीय अपील, प्रथम अपीलीय अधिकारी के निर्णय के अभाव में ठुकराया जा चुका है. आप संलग्न फाईल में माननीय उच्च न्यायालय के आदेश का अवलोकन कर सकते हैं.

The news report says you are calling off your protest only on the basis of a telephone call Shiela (!) had with one of your aides. What is wrong with you? Are you fit to be President of a political party in which Shri Shanti Bhushanji has invested so much of his money and staked his personal reputation ?

I hope you insist that each and every one of those 1.05 million replies you claim to have from the people of Delhi (which, knowing you, I greatly doubt exist) shall be properly diarised and filed for future reference and action.

To aid you, I shall certainly file an RTI seeking to know the diary nos. of all those persons who I suspect to be consumers of stolen electricity which you and your political associates supply (in "black").

Actually, if you had any honest intentions, you would file those 1 million letters directly to the DERC, so that the DISCOMs could be directed by Mr Sudhakar take the appropriate action to curtail this 'bijli theft' by your clients.

Otherwise please sell the letters as 'raddi' (waste paper), at least you can raise some party funds in that way.

Agreed but if PM is prisoner of corrupt opportunists then how can he be a PM too at the same time!  He should either be declared prisoner of war ,or should resign, or be removed! That simple!

      Everywhere in the world where Democracy is in vogue for Administration of the State, there are no leaders. All those in Legislatures and/or outside shouting to do something are politicians. Politicians by the definition in GoogleSearch has the character as stated in the attachment. Kindly let us know where from you get leaders? In Bhaarat especially the पुढारी are only politicians. There cannot be anyone as a leader unless he is politician. Under such condition you cannot have leaders at all. We must find some other way to have leaders, don't you agree sir?
