                                                                       AN  INDIAN CORRUPTION  STORY

 

Though it is a few years now since RTI Act has been enacted,  this has not been able to reduce the level

 of corruption and nepotism in the country to any visible  extent.  Obviously, it implies that  laws  however strong it may be, cannot defeat the forces of corruption , unless there would be determined and strong minded  activists willing to  make the necessary  sacrifice for the sake of the cause. Let not anyone think that I am belittling the RTI Act but only express my deep anguish at the state of affairs in the country.


While Himalayan corruption gets some media attention, thousands of petty corruption taking place all over India everyday  go unreported.  Common  men suffer heavily due to this sort of corruption. What is needed is concerted campaign urging people to resist corruption at the individual level at day today life and corrupt  politicians and bureaucrats should be humiliated by the individuals at every opportunity and such people should be boycotted.  This is not a difficult job but a sustained micro level campaign is necessary.


Read the story below that took place in August,2012  and  this is the typical pattern of corruption in India , exposing the innocent and law abiding citizens who feel frustrated and hopeless.



A gentleman applied for legal heirship certificate to the Tahsildar office . He was asked to fill the form with around ten details. He filled it up and brought the form next day to the Tahsildar office.  He was asked to produce some more details with proof. He brought it again to the office after three days. He was then told that some information were not complete and therefore he has to resubmit the form.  He did this again and brought it the next day and he was asked to come after ten days. When he went after ten days, he was asked to come after another ten days.

 

The tired applicant asked the clerk straightaway what exactly he would want. Then the clerk told him "with reluctance" that  donation of Rupees one thousand was required for a "noble cause".  Expecting this, the applicant immediately gave

Rs. 1000/-.  He was then given a receipt as donation for a flag hoisting ceremony and the receipt had no number and no signature.

 

Then, a copy of the receipt was put in the file along with the application and immediately sent to higher authority. Obviously, the higher authority looking into the file and receipt would know that "the donation"  has been paid.

 

In the next few days, the clerk went out of the way to call the applicant over telephone , spoke to him very affectionately like a brother and said that his certificate was ready.

 

As the applicant did not want to look at the face of the clerk again, he sent someone else to collect the certificate.  Thus ended one more story of Indian corruption.

Thank you very much.

I always thought that there must be many many more defrauded
by forged POA like this.

We have to do something seriously about it. They should not be allowed to
go scot free committing such crime.

I have solid proof. SEBI doesnot care to even see it even though I
volunteered to send it.

What should we do?

Any ideas?

It is high time  that a silent movement should be started to boycott the corrupt politicians and bureaucrats in a way similar to Gandhiji's movement to boycott foreign clothes.
Let not anyone invite those politicians and bureaucrats facing corruption cases in courts  to any public functions  or gatherings and the people  should refrain from attending any gatherings  where such corrupt people would be the invitees.
Educated people should give a lead and spread this message and certainly everyone including the people belonging to lower economic group who are much bigger sufferers of corrupt conditions, would follow suit. This can be a very effective and dignified as well as peaceful anti corruption movement that is bound to spread very fast , given the mood of the country men today.
Every citizen concerned about corrupt conditions can take a lead at his own level, without looking for some one from somewhere to give a lead.
Please consider circulating this message  everywhere in India  and watch the dramatic results for better.

[HumJanenge] Awake Up Call for Humjanenge Group

Dear All,


I would like to state that we have a very active forum for the discussion of many important topics. I many times get impressed and inspired by the fact, that nearly all the members are active and are interested for the development of the Indian Public and society and many people selflessly helps other to overcome the babu walls.


Our members (me judging from their comments/guidance) have diverse education, exposure to their respective functional fields and are well versed with RTI act and other regulations. As these are the same people who have different backgrounds, their thoughts and their way of communication are unique. Some are soft, Some are directionless, Some are rude, and some in need for help. (No, I am not mentioning Mr. Roy as rude). 


But nonetheless, all such people move through different ways, styles and protocols into establishing same goal of bringing transparency in the government system.

Currently the we all are fighting our own individual battles, And Hence are unable to have a greater effects for the improvement in the Indian Society and babudom.


Hence I request, some kind of committee to be formed within HJ group and do the following:-


1. Identify the deficiency, Part by Part.

2. Plan for the action

3. Allocate people who will execute the same.

4. Execute Applications

5. Monitor the applications

6. Coordinate with our own people for the any problems or guidance.

7. Publicize the same on every media. (Like Wikileaks)

8. Inspire a wide range of common people to participate in media action and awakening against malpractices.


For the execution, forming the Sub committees (Pan India) like those who will deal only in the military affairs, accordingly sub sub group as per location for convenience and followups that our Babu requires to greatest levels. Experienced Persons will be heading such committee, we can have online polls for the same. Participation will be voluntary but will have some responsibilities.


Everyone is welcomed to participate in the such committee, even if you are beginner, help the combined strength grow by publicizing the deficiency through every media you may have (gmail, twitter,facebook, linkedin,etc...). In the age of Kaliyuga, unity is only power. Someone in the group had once suggested that a single "ninja" can cause a lot damage but not a group due to decrease in the individual intelligence when in group, but I disagree with same, ninjas in numbers are very very lethal and can have major changes in the societies.

Please note, I will not be an Head or something of such exercise or have any vested interests, I am only a selfish 25 years old guy, how understands now that social awakening is now a must for better future for myself, my children, my grand children.

Information Sought:
The appellant sought information on 11 points regarding 05 letters sent to CIC viz. proof of Delivery, status of speed post etc and also mentioned some delayed speed post deliveries asking about procedure to claim compensation, the delivery norms for speed post and reasons for removing the compensation policy from the website.

Reply of CPIO:

CPIO has replied point wise to the queries of the appellant. However, some information has been denied on the ground of policy matter and non-availability of data.

Grounds of First Appeal:
Not satisfied with the information provided by CPIO.

FAA order:
The website is being maintained by PTC Mysore on instructions of Postal Directorate. This office has no role in this matter hence the same is being forwarded to the relevant authorities and the appeal is disposed off accordingly.

Relevant Facts emerging during Hearing:

The following were present

Appellant: Mr. M K Gupta
Respondent: Mr. Brij Bhushan Arya CPIO's representative

The appellant stated that he has not been provided proper & timely information in response to his RTI application dated 01/09/2010. He contended that information in respect of para 2 (vi, ix & x) was furnished o him only on 16/08/2012 and the procedure for obtaining compensation in case of loss/delay of speed post articles was not uploaded on the website. In this connection he quoted para 5 of the Commission's earlier order in appeal No. CIC/DS/A/2009/000026, dated 27/1/2010 observing as follows:

"Also, each major centre should ensure that complaints received through e-mail are responded to immediately way of confirmation of receipt of the e-mail with an assurance that the complaint would be looked into and decision taken within 7 to 10 working days. The booking centre should then inform the complainant regarding his refund on telephone so that the complainant does not have to make one or more trips to the post office to

(a) Make his complaint
(b) To follow up on the complaint; and
(c) To take his refund as the visits will cost him more than the amount of the refund

thereby making the entire exercise inequitable and loaded in favour of the public authority who has already received in advance the charges for a service that they did not ultimately provide." The CPIO's representative stated that the delay occurred as the information had to be obtained from PTC Mysore which took some time. As regards loading of the process for claiming compensation on the website the matter would be taken up with the higher authorities.

Decision Notice:

After hearing submissions of both the parties it is directed that a copy of the Commission's order in appeal no. CIC/DS/A/2009/000026, dated 27/01/2010 be placed before the Secretary, Department of Post, for taking appropriate action; particularly on the issue of simplifying the cumbersome procedure for claiming refund/compensation for delay/loss of speed post and loading the same on the website.

As regards the delay in furnishing of complete information to the appellant the Commission directs the CPIO to furnish his written submissions within 15 days of the receipt of this order explaining whether he had any reasonable cause for not providing complete/timely information to the appellant. In case he fails to provide any satisfactory reply the Commission may consider imposing penalty on him in terms of the provisions of Section 20(1) of the RTI Act.

The appeal is disposed of accordingly.

This decision is announced in open chamber.

Notice of this decision be given free of cost to the parties.
