There is a builder at Bangalore known as Alpine Housing Development Corporation Limited- website: www.alpinehousing.com
I booked a flat with him in one of his under-construction property titled "Alpine Viva" in January 2007, and signed the agreements on 13- Mar-2007.
He promised the completion by July 2008 but midway he told me that the land on which the project was coming up was notified for acquisition by the govt and it took him 6 months time
to get the land de-notified by the govt and hence the delay so no penalty would be paid to any customer. He has taken 90% of the money from me, and my loan a/c by Jan-2009.

When I filed the RTI letter to Bangalore Development Authority, I got to know that the land was notified for acquisition on 15/11/2006 whereas he signed the agreements with me 4 months after the notification. When I confronted with the said fact, he offered me a flat in another project. This flat is a ready to move in flat and little bigger in size also.

The agreements were signed for the new flat in Mar-2011. After the agreement I asked him to complete the property tax, and betterment charges to Bangalore civic authorities. After this he stopped responding to me over e-mails, and letters and his officers started telling lies. I have been fighting with them for past 1 yr. On 31st of last month Alpine called me for a meeting at Bangalore, however, despite my repeated attempts he did not sent me an e-mail invitation. I came from Delhi to Bangalore and he promised me a resolution in a week's time. It has been 20 days to it and I am still at Bangalore, and Alpine Housing is still evasive, Their officers don't reply, The MD himself doesn't pick my calls, I have made over 100 calls to him but he don't any of my calls.

I was completely dismayed by his act, and decided to go to his office and sit there even if nobody talks to me. From 12:30 afternoon on Saturday and peacefully sat there until 7'o clock. I apprised the lady at the reception that I have come to meet one of their officers who met me on 31st- may, and who promised me the resolution in a week's time. Neither the officer came nor the M.D. came.

When it was 6' o clock the lady at the reception asked me to go and come on Monday, I said, I will wait until someone come and that you may lock me inside. I will not hinder in your functions. Slowly everybody left by 6:30 PM.

When I did not see anybody there, I too left at 7' o clock. I don't know what to do further?

Any suggestions ?

I read many mails in this conversation. 

The main agenda here is the curbing the corruption and removing the corrupt people from the high level ( even below) 
I remembered that some time ago the SC commented to CBI, "Why are you after small case, can't you see big fish?" in case of watchman taken rs 100/- bribe. The case gone to SC!!!!

Now the time is come to catch the high flyer. 
The proposed bill covers all the high flyer, except PM, Chief Justice etc.. under debate now a days. 

But still there is some doubts : 
What is corruption? 

Not following the rules and regulation? In case some officer in the circumstances does not follows the rules and regulation .(the situation one can imagine any) will he be corrupt. i.g. one businessman says the poor stolen roti from his hotel, the police man did not arrest that poor man!!!

Will the saying one is corrupt, that will be comes under the ACT(proposed). When I say X is corrupt. At present the Sonia Gandhi is soft target (May be political reason) Will LKA be targeted for his name in Jain dairy? 
Next relevat Que in this regard, if one's name appears in other corrupt people, will that ONE be have to face the case under LOKPAL? Than every under world threatens the Police commissionaire, Home Minister that I keep one dairy in which your (PC, HM) name is appaering. If you dare to touch me , you also be finished. !!!!

Who decides that in whose case the LOKPAL is applicable. Just saying that X is corrupt, though he may be honest one, what action is there to punish the other one? 

Saying is very easy that cover even the PM, all citizens are covered and no one has the perfect account, just one can not able to  establish 100% true account, be punished? 

The other side must be watched. Other wise the real corrupt people will settle the honest one.
Will the present LOKPAL BILL have sufficient safeguards of being mis-used?

He must learn from Sridharan ji of the Delhi Metro of what decision
making and leadership is and how it is demonstrated. You cann ot be a
Premier and not supervise how the Foreign Minister managing things and
events...and the same applies to the rest of his Ministry or the
PMO...!

Matters and events have gone beyond the politicians; most of us tend
to indulge in 'a sleight of hand' to what have you. That is called
clever and smart.
The gentle and the honest one is called a "buddhu" and a "soft one"
and will not go far in life -- in a job, or with a woman or moving up
in one's career.

Good character and honesty of purpose gets appreciated -- I do not
deny that and it does get rewarded. BUT our corrupted character and
"being clever" has left us as a highly "chalak" and a corrupt nation,
among whom possibly the politicians are the worst element since they
run the roost and get away -- by buying the votes, suppressing the
havaldar or Inspector, getting the Supervisor or a headmaster or a
Director by getting other pressures under way and thus the higher
echelons are made to bend.

See how in another context, professionals and those who matter tend to
"kow tow" when a Rahul Gandhi passes by -- which is NOT his fault --
yet he does not mind 'making a buck' of a different kind so that
possibly he eventually gets to warm the seat of the Premier, one day,
even though he is not guilty of ever wanting to own it now or in the
next general elections.
That is how our democracy gets defined by the best and the worst among
us-- as a nation-- that is how we are "corrupted". Which Lokpal will
arise to repair these major flaws in our national character?

Corruption should not merely be seen in relation to the ducats but
beyond in how loyal and sincere we are in what a Gandhi or a Vinobha
stood for.

One Baba lies in hospital room leaving the world after 4 months of
fasting because the Ganga is NOT getting cleaned while the other Baba
in the next room after 9 days is welcomed and put on every TV channel
seen breaking the fast and then declaring that he needs to pay his
taxes having made a buck that runs in hundreds of crores over the past
few years!!

You know what I am comparing and suggesting how we as a community and
a nation have eroded -- what our ideals were and what our Constitution
and what our Dharam stands for.

Our corruption today is of a kind we are running, at all our different
levels a nautanki of sorts (as Digvijai says in another, biased way)
unconcerned with the kind of standards we are laying down for those
who follow us in the family or in a neighbourhood or the Panchayat or
the local body and beyond in public work in the Legislatures and the
Houses of Parliament.
And the President cannot decide who must get hung or go inside for
life -- everything remains in an unending queue of sorts... to what
end? Who will get to do his/her job within a month, a year or 2-3
years or never...and not be accountable.
IT IS THAT BAD.

24) can approach the CAT; and CAT can ask for all the service-related
information, why an employee is disallowed these information. Infact,
it is the interpretation of the provisions which is most important.

I am sharing one more similar decision given by Shri Satyananad Mishra, Chief Information Commissioner in the case of Shri Neeraj Mehta, an other applicant (name not disclosed on request) and in my case relating to Cabinet Sectt.

 

Background of the case of Mr. Mehta

 

He appeared in an exam for the Dy. Field Officer conducted by the Cabinet Sectt. and asked about the outcome of the examination. 

 

2.         Case of another applicant

 

She has applied for the post of Research Officer but on not receiving any information on the status of her application, requested to inform as follows:

 

i.                     Status in respect of the recruitment.

ii.                   Status of her candidature.

iii.                  Whether the letters for the test/ interview have been issued or are being issued.

iv.                 Eligibility criteria.

 

Shri Ashok Kumar, Director (SR) replied on 12 Feb. 2009 that RAW, Aviation Research Centre (ARC) and Special Frontier Force (SFF) are under the Cabinet Sectt. which figures in the Second Schedule are exempted from the purview of the RTI Act.  Mr. Kumar further added that hence RAW being an orgn. dealing with the Security and Intelligence, it would not be possible to furnish the infn.  Besides, there is no involvement of human right violations and allegations of corruption, therefore, this Sectt. is not under any obligation to provide the infn.  Shri K B S Katoch, Appellate Authority and Addl. Secy. confirmed the decision of the CPIO giving many citations. 

 

In the recent past, Division bench of Kolkata High Court has allowed to see even answer sheets. CIC has now also allowed to see answer sheets.

 

3.         In my RTI application, I requested for information on the posts of Research Officer, Asstt. Foreman and Trainee Pilot (Rotary Wing) advtd. by the Cabinet Sectt., eligibility criteria laid – down for issuing calls for written exam and/ or interview for Research Officer, to furnish the list of candidates who have been called for appearing in the written exam or test.

 

One query was Compelling circumstance for adopting secretive and closed-door practice undertaken for the recruitment process by directing the candidates to address application to the post-box number only as such overt practices are against the transparent working in this age of RTI Act.

 

            I also mentioned in my application that the exemption granted to three organs under the Cabinet Sectt. is not absolute but 'provided that the infn pertaining to the allegations of corruption and human rights violations shall not be excluded under that sub-section'.  Clearly, not giving opportunity to the deserving candidates or not disclosing the criteria raises apprehension of corruption in the recruitment.  Depriving the eligible candidate from competeting for the post is violation of human and fundamental right too and the FR as above all other laws.  The FAA and CIC rejected the appeals for information.

 

These are the reasons that the public has started a forceful campaign against the corruption in a big way. 

 

The decisions mentioned in the earlier email and the three decisions mentioned above need to be challenged in the High Court but the poor candidates do not have expertise and resources to seek the High Court intervention.  

 

However, if they get some lawyer who is ready to fight above mentioned cases, they can challenge the decision of the CIC.

2. We heard both these cases together since both relate to public authorities included in the Second Schedule to the Right to Information (RTI) Act. The Appellant was present in one of the cases (000995); the CIC/WB/A/2009/000931 & 995SM Appellant in the other case was not present in spite of notice. The Respondents were present. We heard the submissions of all.

 

3. In both the cases, the information sought is related to personnel matters, in one case, about the outcome of the selection for the post of Deputy Field Officer and in the other, about the feeling of the post of Research Officer/Trainee Pilot. In both the cases, the CPIO concerned declined to provide any information by claiming that the respective organisations was included in the Second Schedule to the Right to Information (RTI) Act and, therefore, the provisions of the Right to Information (RTI) Act did not extend to those organisations.

 

4. The Appellant submitted that all that he wanted to know was whether the results of the examination conducted for recruitment to the post for which advertise meant had been issued were declared or not.

 

He further submitted that, for the sake of transparency, such information should be disclosed in the public domain. On the other hand, the Respondents submitted that, irrespective of the nature of information sought, the CPIO was not obliged to provide any information since the organisation itself was included in the Second Schedule.

 

5. After carefully considering the facts of the both the cases and the submissions made by the Appellant present, we tend to agree with the decision taken by the CPIO in each of these cases. In neither of these cases, the information sought had any relation to the human rights violation or corruption, the only grounds on which information could have been given. Consequently, the appeals are disallowed.

If there is any decision from the High Court overturning the CONSISTENT view of the CIC can IC(SG) share it or at least put it up on the CIC website uner the relevant link.

It has been 20 days to it and I am still at Bangalore, and Alpine Housing is still evasive, Their officers don't reply, The MD himself doesn't pick my calls, I have made over 100 calls to him but he don't any of my calls.

I was completely dismayed by his act, and decided to go to his office and sit there even if nobody talks to me. From 12:30 afternoon on Saturday and peacefully sat there until 7'o clock. I apprised the lady at the reception that I have come to meet one of their officers who met me on 31st- may, and who promised me the resolution in a week's time. Neither the officer came nor the M.D. came.

When it was 6' o clock the lady at the reception asked me to go and come on Monday, I said, I will wait until someone come and that you may lock me inside. I will not hinder in your functions. Slowly everybody left by 6:30 PM.

When I did not see anybody there, I too left at 7' o clock. I don't know what to do further?

Any suggestions ?

In a recent decision by IC(Shailesh Gandhi) on May 13. 2011 [CIC/SM/A/2011/000277/SG]
he disallows an employee of RAW (exempted organisation u/s 24 ) from receiving information about why his salary is not being paid, incidentally the appellant took the stand that non-payment of salary is a human rights violation and hence exemption u/s 24 does not apply.

Contrast this with a  "ballsy" decision on similar point  by IC(M/L.Sharma) [CIC/LS/A/2010/001277]
where IC(MLS) states that the Commission CONSISTENTLY holds that administrative matters of an intelligence organisation exempted u/s 24 are not covered by the exemption and information will be disclosed.

If there is any decision from the High Court overturning the CONSISTENT view of the CIC can IC(SG) share it or at least put it up on the CIC website uner the relevant link.

At 1 point of time this was a criminal matter heavily in your favour, but you condoned his crime so now it is a civil matter between you and builder as per the various agreements and assurances you have entered into.

Have you got possession ? Is the entire new ready to move in apartment project stuck up ? From what I read in the papers,  a vast number of small time builders are in deep financial trouble and there is a housing bubble.

Isn't it obvious from Alpine's website that they are a dubious organisation..

What does your advocate have to say on this ?

I booked a flat with him in one of his under-construction property titled "Alpine Viva" in January 2007, and signed the agreements on 13- Mar-2007.
He promised the completion by July 2008 but midway he told me that the land on which the project was coming up was notified for acquisition by the govt and it took him 6 months time

The agreements were signed for the new flat in Mar-2011. After the agreement I asked him to complete the property tax, and betterment charges to Bangalore civic authorities. After this he stopped responding to me over e-mails, and letters and his officers started telling lies. I have been fighting with them for past 1 yr. On 31st of last month Alpine called me for a meeting at Bangalore, however, despite my repeated attempts he did not sent me an e-mail invitation.
