You are great sarabjit and correct.
 
To varify the Ministry could have got all the Hospital records and Confirm. There was no need to go for any Legal advise. the factual data would have been sufficient to come to a conclusion.The ministry based on the facts could have given the decision to the chief/IH of MOD(Army) to coerrect the DOB, that is what the Chief wants.Fixing the date of retirement is a separate issue.
There seems to be some motive for not accepting the DOB as 1951, there seems to be urgency to retire him. Govt should be bold to accept the correct DOB, restore the chiefs respect and integrity and may still direct him to retire this year as a cabinet decision.
 
If I am not wrong the PPO for pension is issued by AG's Branch. The DOB of cOAS is 1951 as per AG's record.How are they going to issue the PPO since as per their record he is to retire next year. For one year either he gets Pay with out work or no pension . His commutation.Gratuaty etc will also will be due next year as per AG's record.
 
GOD save the govt from the mess????
